Article 2, paragraph 1, of that Convention defines " forced labour or services " as: " All work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily. "
فالفقرة 1 من المادة 2 من هذه الاتفاقية تعرِّف " الأعمال أو الخدمات القسرية " بأنها: " كل أعمال أو خدمات تُطلب عنوةً من أي شخص تحت التهديد بأي عقوبة ولم يتطوّع هذا الشخص لأدائها بمحض اختياره " .

International Labour Organization (ILO) Convention (No. 29) concerning Forced Labour defines " forced or compulsory labour " as all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily (art. 2).
أما الاتفاقية رقم ٩٢ الصادرة عن منظمة العمل الدولية والمتعلقة بالعمل الجبري، فإنها تقصد بتعبير " العمل الجبري أو الالزامي " كل أعمال أو خدمات تغتصب من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص ﻷدائها بمحض اختياره )المادة ٢(.

It would therefore be inappropriate to use auctions in procurement of works or services entailing intellectual performance, such as design works, and other quality-based procurement.
لذلك لن يكون من المناسب أن تُستخدم المناقصات الإلكترونية في اشتراء أعمال أو خدمات تقتضي إبداعا فكريا كأعمال التصميم، وغيرها من عمليات الاشتراء المبنية على الجودة.

The Committee further noted that under the Labour Code of 1992, the term " forced or compulsory labour " does not include any work or service in the general interest forming part of the civic obligations of citizens as defined by the laws and regulations.
ولاحظت اللجنة أيضاً أنه بموجب قانون العمل الصادر في عام 1992 لا يشمل " العمل الجبري أو القسري " أي أعمال أو خدمات للمصلحة العامة كجزء من الالتزامات المدنية للمواطنين على النحو المنصوص عليه في القوانين واللوائح.

9. The International Labour Organization defines forced labour as " all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily " .
9- وتعرِّف منظمة العمل الدولية العمل الجبري على أنه " كل أعمال أو خدمات تُطلب عنوةً من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص لأدائها بمحض اختياره " ().

4.11 The State party observes that the Covenant's exception for " any work or service which forms part of normal civic obligations " is not specifically defined, but should be interpreted against the backdrop of the minimum standards contained in ILO Convention No. 29.
4-11 وتلاحظ الدولة الطرف أن استثناء " أي أعمال أو خدمات تشكل جزءاً من الالتزامات المدنية العادية " في العهد غير معرّفٍ بدقة، ولكن ينبغي تفسيره على خلفية المعايير الدنيا المدرجة في اتفاقية منظمة العمل الدولية رقم 29.

وتعرّف المادة 2 من اتفاقية منظمة العمل الدولية رقم 29 العمل الجبري بأنه " كل أعمال أو خدمات تغتصب من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص بأدائها بمحض اختياره " .

31- يُعرّف العمل القسري بأنه " كل أعمال أو خدمات تُغتصب من أي شخص تحت التهديد بأية عقوبة ولم يتطوع هذا الشخص بأدائها بمحض اختياره " ().

(ii) Any work or service not referred to in subparagraph (b) (i) of this article that is normally required of a person who is under detention in consequence of a lawful order of a court or of a person during conditional release from such detention;

In ILO Convention (No. 29) Concerning Forced or Compulsory Labour, forced labour was defined as " all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily " .
وفي اتفاقية منظمة العمل الدولية (رقم 29) المتعلقة بالعمل الجبري أو الإلزامي عرفت السخرة بأنها " كل أعمال أو خدمات تُغتصب من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص بأدائها بمحض اختياره " .

3.1 The author refers to article 2, paragraph 1, of ILO Convention No. 29 (1930) concerning Forced or Compulsory Labour which defines forced or compulsory labour to mean " all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily " .
3-1 يشير صاحب البلاغ إلى الفقرة 1 من المادة 2 من اتفاقية منظمة العمل الدولية رقم 29(1930) المتعلقة بالعمل الجبري، التي يُقصد فيها بتعبير العمل الجبري أو الإلزامي " أي أعمال أو خدمات تغتصب من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص بأدائها بمحض اختياره " .

The " UNODC Model Law against Trafficking in Persons " offers the following definition of forced labour or other services (derived from the ILO Convention No. 29): " Forced labour or other services shall mean all work or service that is exacted from any person under the threat of penalty and for which the person concerned has not offered him- or herself voluntarily. "
13- ويقدم " القانون النموذجي لمكافحة الاتجار بالأشخاص " ، الذي أعده مكتب الأمم المتحدة المعني بالمخدرات والجريمة، التعريف التالي لمصطلح العمل الجبري (السخرة) أو الخدمات القسرية الأخرى (المستمد من اتفاقية منظمة العمل الدولية رقم 29): " يقصد بتعبير " العمل الجبري أو الإلزامي كل أعمال أو خدمات تغتصب من أي شخص تحت التهديد بأي عقوبة، ولم يتطوّع هذا الشخص بأدائها بمحض اختياره. " ()

Anyone who makes use of labour or services that are the object of exploitation as defined in article 8, paragraph 2, with the knowledge that the person is a victim of trafficking shall be guilty of an offence and, upon conviction, shall be liable to imprisonment for ... and/or a fine of/up to ...[a fine of the ... category].
كل من يستفيد من أعمال أو خدمات هي موضع استغلال، بحسب تعريفه في الفقرة 2 من المادة 8، عن علم بأنَّ الشخص المستغل هو ضحية اتجار بالأشخاص، يكون مذنبا بارتكاب فعل جرمي، وعند إدانته يكون عرضة لعقوبة السجن لمدة ... أو لغرامة قدرها .../تصل إلى ... [الغرامة من فئة ...] أو لكلتا هاتين العقوبتين.

Anyone who knowingly makes use of or profits from labour or services performed or rendered under conditions of exploitation as defined in article 8, paragraph 2, [labour or services performed or rendered by a victim of trafficking in persons] shall be guilty of an offence and, upon conviction, shall be liable to imprisonment for ... and/or a fine of/up to ... كل من يستفيد أو يجني ربحا، عن علم وقصد، من أعمال أو خدمات تُؤدى أو تُقدَّم في حالات استغلال، بحسب تعريفها في الفقرة 2 من المادة 8، [أعمال أو خدمات يؤديها أو يقدمها شخص واقع ضحية اتجار بالأشخاص]، يُعتبر مذنبا بارتكاب فعل جُرمي، وعند إدانته يكون عرضة لعقوبة السجن لمدة ... أو لغرامة قدرها .../تصل إلى ... [الغرامة من فئة ...] أو لكلتا هاتين العقوبتين.
