بيد أنه ليس هناك من إنفاذ للتشريع المذكور؛ ولهذا هناك إفلات من العقاب على ما يرتكب من أعمال العنف ضد النساء والفتيات.

1. Strongly condemns all acts of violence against women and girls, whether these acts are perpetrated by the State, private persons or non-State actors, and calls for the prevention and elimination of all forms of gender-based violence in the family, within the general community and where perpetrated or condoned by the State;
1- يدين بشدّة جميع أعمال العنف ضد النساء والفتيات سواء تلك التي ترتكبها الدولة أو أشخاص عاديون أو جهات فاعلة من غير الدول، ويدعو إلى منع جميع أشكال العنف الجنساني والقضاء عليها داخل الأسرة، وفي المجتمع عموماً، وحيثما كانت الدولة هي التي ترتكبه أو تتغاضى عنه؛

The Assembly stressed that States have the obligation to promote and protect all human rights and fundamental freedoms of women and girls, exercise due diligence in order to prevent, investigate and punish the perpetrators of violence against women and girls, and provide protection to the victims.
وشددت الجمعية العامة على الالتزام المترتب على الدول بتعزيز وحماية جميع حقوق الإنسان والحريات الأساسية للنساء والفتيات، وبذل العناية الواجبة لمنع ارتكاب أعمال العنف ضد النساء والفتيات والتحقيق مع مرتكبيها ومعاقبتهم، وتوفير الحماية للضحايا.

Eradicate and eliminate violent acts against women and girls and empower victims and survivors
القضاء على أعمال العنف ضد النساء والفتيات واستئصالها وتمكين الضحايا والناجيات

1. Strongly condemns all acts of violence against women and girls, whether these acts are perpetrated by the State, private persons or non-State actors, and calls for the elimination of all forms of gender-based violence in the family, within the general community and where perpetrated or condoned by the State, in accordance with the Declaration on the Elimination of Violence against Women;
1- يدين بشدّة، وفقاً للإعلان المتعلق بالقضاء على العنف ضد المرأة، جميع أعمال العنف ضد النساء والفتيات التي ترتكبها الدولة أو الأفراد أو جهات فاعلة من غير الدول، ويدعو إلى القضاء على جميع أشكال العنف القائم على نوع الجنس داخل الأسرة وفي المجتمع عموماً، والعنف الذي ترتكبه الدولة أو تتغاضى عنه؛

40. In its resolution 23/25 on accelerating efforts to eliminate all forms of violence against women, the Human Rights Council strongly condemned all acts of violence against women and girls, whether perpetrated by the State, private persons or non-State actors.
40 - وأدان مجلس حقوق الإنسان بشدة، في قراره 23/25، المتعلق بتكثيف الجهود الرامية إلى القضاء على جميع أشكال العنف ضد المرأة، جميع أعمال العنف ضد النساء والفتيات سواء التي ترتكبها دولة أو أفراد أو جهات فاعلة من غير الدول.

Stressing that States have the obligation to promote and protect all human rights and fundamental freedoms for all, including women and girls, and must exercise due diligence to prevent and investigate acts of violence against women and girls and punish the perpetrators, eliminate impunity and provide protection to the victims and that failure to do so violates and impairs or nullifies the enjoyment of their human rights and fundamental freedoms,
وإذ تؤكد أن الدول ملزمة بتعزيز وحماية جميع حقوق الإنسان والحريات الأساسية للجميع، بمن فيهم النساء والفتيات، وأنه يجب عليها أن تسعى جاهدة على النحو الواجب لمنع ارتكاب أعمال العنف ضد النساء والفتيات والتحقيق فيها ومعاقبة مرتكبيها ووضع حد للإفلات من العقاب وتوفير الحماية لضحاياها، وأن عدم القيام بذلك يشكل انتهاكا لحقوق الإنسان والحريات الأساسية للنساء والفتيات ويخل بتمتعهن بها أو يحول دون ذلك،

(x) Prevent, investigate and punish acts of violence against women and girls that are perpetrated by people in positions of authority, such as teachers, religious leaders, political leaders and law enforcement officials, in order to end impunity for these crimes;
(خ) منع أعمال العنف ضد النساء والفتيات التي يرتكبها أشخاص مؤثرون، مثل المدرسين ورجال الدين والقادة السياسيين والمسؤولين عن إنفاذ القانون، والتحقيق في تلك الأعمال والمعاقبة عليها بغية إنهاء الإفلات من العقاب على هذه الجرائم؛

Since 2009, resolutions from the two bodies have called upon States to " exercise due diligence to prevent and investigate acts of violence against women and girls and punish the perpetrators " , including by putting in place penal and criminal sanctions to punish perpetrators and by providing redress and justice mechanisms that victims can access effectively.
ومنذ عام 2009، دعت قرارات الهيئتين الدول إلى إيلاء العناية الواجبة لمنع ارتكاب أعمال العنف ضد النساء والفتيات والتحقيق فيها ومعاقبة مرتكبيها()، بما في ذلك بغرض جزاءات عقابية وجنائية لمعاقبة الجناة وبإتاحة آليات الجبر والعدالة التي تمكن الضحايا من الوصول إليها بصورة فعالة.

4. Reaffirms that States have an obligation to exercise due diligence to prevent, investigate and punish the perpetrators of violence against women and girls and to provide protection to the victims, and that failure to do so violates and impairs or nullifies the enjoyment of their human rights and fundamental freedoms;
4- تؤكد من جديد أن على الدول التزاما ببذل العناية الواجبة لمنع ارتكاب أعمال العنف ضد النساء والفتيات والتحقيق فيها والمعاقبة عليها وتوفير الحماية للضحايا، وأن عدم القيام بذلك، يشكل انتهاكاً لتمتعهن بحقوق الإنسان والحريات الأساسية وانتقاصاً منه أو إلغاءً لـه؛

84. violence against women and girls as a whole and domestic violence in particular constitute criminal offences under the criminal code.
84- تشكل أعمال العنف ضد النساء والفتيات بوجه عام وأعمال العنف المنزلي بوجه خاص جرائم جنائية منصوصاً عليها في القانون الجنائي.

The concern over `the lack of effective measures to prevent and prosecute violence perpetrated against women and girls by military personnel, including foreign military personnel stationed on military bases' as stated by the Committee Against Torture in its last conclusion and recommendation is obviously based on a misunderstanding.
من الواضح أن القلق إزاء ' عدم وجود تدابير فعالة لمنع أعمال العنف ضد النساء والفتيات التي يرتكبها العسكريون، بمن فيهم العسكريون الأجانب المرابطون في قواعد عسكرية، ومقاضاتهم عليها` كما ذكرته لجنة مناهضة التعذيب في ملاحظاتها وتوصياتها الأخيرة قائم على سوء فهم.
