10. States Parties shall endeavour to promote the reintegration into society of persons convicted of offences established in accordance with this Convention.
10- تسعى الدول الأطراف إلى تشجيع إعادة إدماج الأشخاص المدانين بارتكاب أفعال مجرّمة وفقا لهذه الاتفاقية في مجتمعاتهم.

Each State Party shall ensure that, in the case of domestic criminal investigations of offences established in accordance with this Convention, there are appropriate mechanisms available within its domestic legal system to overcome obstacles that may arise out of the application of bank secrecy laws.
تكفل كل دولة طرف، في حال القيام بتحقيقات جنائية داخلية في أفعال مجرّمة وفقا لهذه الاتفاقية، وجود آليات مناسبة في نظامها القانوني الداخلي لتذليل العقبات التي قد تنشأ عن تطبيق قوانين السرية المصرفية.

Each State Party shall also consider taking such measures as may be necessary to permit its competent authorities to share that information with the competent authorities in other States Parties when necessary to investigate, claim and recover proceeds of offences established in accordance with this Convention.
وتنظر كل دولة طرف أيضا في اتخاذ ما قد يلزم من تدابير للسماح لسلطاتها المختصة بتقاسم تلك المعلومات مع السلطات المختصة في الدول الأطراف الأخرى، عندما يكون ذلك ضروريا للتحقيق في العائدات المتأتية من أفعال مجرّمة وفقا لهذه الاتفاقية والمطالبة بها واستردادها.

(a) Proceeds of crime derived from offences established in accordance with this Convention or property the value of which corresponds to that of such proceeds;
(أ) العائدات الإجرامية المتأتية من أفعال مجرّمة وفقا لهذه الاتفاقية، أو ممتلكات تعادل قيمتها قيمة تلك العائدات؛

Article 40 thereof presents another line of attack against bank secrecy, providing that " (e)ach State party shall ensure that, in the case of domestic criminal investigations of offences established in accordance with this Convention, there are appropriate mechanisms available within its domestic legal system to overcome obstacles that may arise out of the application of bank secrecy laws " .
وتشكل المادة 40 من الاتفاقية ضربة أخرى موجهة لمبدأ السرية المصرفية، إذ تنص على أن تكفل كل دولة طرف ' ' في حال القيام بتحقيقات جنائية داخلية في أفعال مجرّمة وفقا لهذه الاتفاقية، وجود آليات مناسبة في نظامها القانوني الداخلي لتذليل العقبات التي قد تنشأ عن تطبيق قوانين السرية المصرفية``.

(b) The use of physical force, threats or intimidation to interfere with the exercise of official duties by a justice or law enforcement official in relation to the commission of offences established in accordance with this Convention.
(ب) استخدام القوة البدنية أو التهديد أو الترهيب للتدخل في ممارسة أي موظف قضائي أو معني بإنفاذ القانون مهامه الرسمية فيما يتعلق بارتكاب أفعال مجرّمة وفقا لهذه الاتفاقية.

7. Where warranted by the gravity of the offence, each State Party, to the extent consistent with the fundamental principles of its legal system, shall consider establishing procedures for the disqualification, by court order or any other appropriate means, for a period of time determined by its domestic law, of persons convicted of offences established in accordance with this Convention from:
7- تنظر كل دولة طرف، حينما تسوّغ جسامة الجرم ذلك، وبما يتوافق مع المبادئ الأساسية لنظامها القانوني، في اتخاذ إجراءات لإسقاط الأهلية، بأمر قضائي أو بأي وسيلة مناسبة أخرى، ولفترة زمنية يحددها قانونها الداخلي، عن الأشخاص المدانين بارتكاب أفعال مجرّمة وفقا لهذه الاتفاقية، للقيام بما يلي:

(b) Property, equipment or other instrumentalities used in or destined for use in offences established in accordance with this Convention.
(ب) الممتلكات أو المعدات أو الأدوات الأخرى التي استُخدمت أو كانت معدّة للاستخدام في ارتكاب أفعال مجرّمة وفقا لهذه الاتفاقية.

1. Each State Party shall take such measures as may be necessary to encourage, in accordance with its domestic law, cooperation between national investigating and prosecuting authorities and entities of the private sector, in particular financial institutions, relating to matters involving the commission of offences established in accordance with this Convention.
1- تتخذ كل دولة طرف، وفقا لقانونها الداخلي، ما قد يلزم من تدابير لتشجيع التعاون بين السلطات الوطنية المعنية بالتحقيق والملاحقة وكيانات القطاع الخاص، وخصوصا المؤسسات المالية، فيما يتصل بالأمور المتعلقة بارتكاب أفعال مجرّمة وفقا لهذه الاتفاقية.

4. With the aim of preventing and detecting transfers of proceeds of offences established in accordance with this Convention, each State Party shall implement appropriate and effective measures to prevent, with the help of its regulatory and oversight bodies, the establishment of banks that have no physical presence and that are not affiliated with a regulated financial group.
4- بهدف منع وكشف عمليات إحالة العائدات المتأتية من أفعال مجرّمة وفقا لهذه الاتفاقية، تنفذ كل دولة طرف تدابير مناسبة وفعالة لكي تمنع، بمساعدة أجهزتها الرقابية والإشرافية، إنشاء مصارف ليس لها حضور مادي ولا تنتسب إلى مجموعة مالية خاضعة للرقابة.
