11- يؤكد من جديد وجوب أن يحظر القانون أي دعوة إلى الكراهية القومية أو العرقية أو الدينية تشكل تحريضاً على التمييز أو العداوة أو العنف، فضلاً عن نشر أي أفكار تقوم على التفوق العرقي أو الكراهية العرقية وأفعال العنف والتحريض على ارتكاب هذه الأفعال، وأن هذا الخطر يتسق مع حرية الرأي والتعبير؛

By concentrating on the fact that Mr. Sarrazin's statements did not amount to incitement of racial hatred and were not capable of disturbing the public peace, the State party failed in its duty to carry out an effective investigation into whether or not Mr. Sarrazin's statements amounted to dissemination of ideas based upon racial superiority or hatred.

23. Greater attention should be paid to the improper use of the media and information technology such as the Internet to spread ideas based on racial superiority or racial hatred, and the international community should take more specific action in that field.
٣٢- إن إساءة استخدام وسائل الاتصال والوسائل المعلوماتية، مثل شبكة إنترنت، لنشر أفكار تقوم على التفوق العرقي أو الكراهية العرقية مسألة ينبغي أن تحظى بمزيد من الاهتمام، وتستوجب تدابير ملموسة من جانب المجتمع الدولي.

While commending the Government of Germany for taking measures to prohibit extremist organizations disseminating ideas based on racial superiority or hatred, the Committee was of the view that appropriate measures should also be strictly applied against such organizations and especially against persons and groups who were implicated in racially motivated crimes.
٤٤٩ - وبالرغم من ثناء اللجنة على الحكومة اﻷلمانية لاتخاذها تدابير لحظر قيام المنظمات المتطرفة ببث أفكار تقوم على التفوق العنصري أو الكراهية، فإن من رأي اللجنة أنه ينبغي أيضا تطبيق تدابير مناسبة بدقة ضد هذه المنظمات ولاسيما ضد اﻷشخاص والجماعات المتورطة في الجرائم المرتكبة بدافع عنصري.

On the other hand, article 4(a) of ICERD prohibits the mere dissemination of ideas based on superiority and racial hatred.

17. CERD reiterated its concern about the absence of domestic legislation classifying as punishable acts the dissemination of ideas based on notions of superiority or racial hatred, incitement to racial discrimination and violence against indigenous peoples or Afro-descendants.
17- وكررت لجنة القضاء على التمييز العنصري الإعراب عن قلقها إزاء عدم وجود تشريع داخلي يجّرم نشر أية أفكار تقوم على مفاهيم التفوق أو الكراهية العنصرية وعلى التحريض على التمييز العنصري وعلى أي عمل من أعمال العنف ضد الشعوب الأصلية أو الأشخاص المنحدرين من أصل أفريقي.

7. The Committee reiterates its concern about the absence of domestic legislation under which the dissemination of ideas based on notions of superiority or racial hatred, incitement to racial discrimination and violent acts directed against indigenous peoples or persons of African descent in the State party are classified as punishable acts (art. 4 (a)).
7- ويساور اللجنة القلق لعدم وجود تشريع داخلي يجرِّم على نشر أية أفكار تقوم على التفوق أو الكره العنصري، وعلى التحريض على التمييز العنصري وعلى أي عمل من أعمال العنف، وبخاصة ضد الشعوب الأصلية والأشخاص المنحدرين من أصل أفريقي الذين يعيشون في الدولة الطرف (الفقرة (أ) من المادة 4).

4.7 With regard to the alleged violation of article 2, paragraph 1 (d), of the Convention, the State party notes that any dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts against any race or group of persons of another ethnic origin constitute an offence punishable by law.
4-7 وتشير اللجنة فيما يتعلق بالانتهاك المزعوم للمادة 2(1)(د) من الاتفاقية إلى أن نشر أي أفكار تقوم على أساس التفوق العنصري أو الكراهية العنصرية، والتحريض على التمييز العنصري، وكذلك جميع أعمال العنف أو التحريض عليها، ضد أي عرق أو مجموعة أشخاص من أصل عرقي آخر، هي أعمال تشكل جريمة يعاقب عليها القانون.

It also observes that article 4 of the Convention codifies the State party's responsibility to protect the population against incitement to racial hatred but also acts of racial discrimination by dissemination of ideas based upon racial superiority or hatred.
وتلاحظ أيضاً أن المادة 4 من الاتفاقية تُقنن مسؤولية الدولة الطرف في حماية السكان من التحريض على الكراهية العنصرية وكذلك أفعال التمييز العنصري من خلال نشر أفكار تقوم على التفوق العنصري أو الكراهية العنصرية().

12.8 While acknowledging the importance of freedom of expression, the Committee considers that Mr. Sarrazin's statements amounted to dissemination of ideas based upon racial superiority or hatred and contained elements of incitement to racial discrimination in accordance with article 4, paragraph (a), of the Convention.
12-8 وفيما تسلم اللجنة بأهمية حرية التعبير، ترى أن تصريحات السيد سارازين تصل إلى حد نشر أفكار تقوم على التفوق العنصري أو الكراهية العنصرية وتتضمن عناصر التحريض على التمييز العنصري وفقاً لأحكام الفقرة (أ) من المادة 4 من الاتفاقية.

" (a) Declaring an offence punishable by law any dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination and all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and the provision of any assistance to racist activities, including the financing thereof;
