23. Article 4 (1) of the Covenant states that the exceptional measures must not be inconsistent with other obligations under international law, particularly the rules of international humanitarian law and the peremptory norms of international law.
23 - وتنص المادة 4 (1) من العهد على أن التدابير الاستثنائية يجب ألا تتنافى مع الالتزامات الأخرى بمقتضى القانون الدولي، ولا سيما مبادئ القانون الإنساني الدولي والقواعد القطعية للقانون الدولي.

(5) The present article provides that countermeasures may not be resorted to when some " appropriate means " for inducing compliance are available. Moreover, the taking of countermeasures need not be based on the rules of the organization, but should not be inconsistent with those rules.
