وثمة ممارسة تنتهجها أيضاً بعض الدول، عند التصديق على اتفاقية، هي إصدار تحفظ ينص على ألا تنطبق المعاهدة على الأعمال الحادثة قبل بدأ نفاذ المعاهدة على هذه الدولة.

9. Paragraph 2 of resolution 1844 (2008) reads as follows: " Decides that the measures imposed by paragraph 1 above shall not apply:

" ٠١ - يقرر ألا تنطبق التدابير المفروضة بموجب هذا القرار على اﻷنشطة المتصلة بقوة الحماية التابعة لﻷمم المتحدة في يوغوسلافيا، أو على المؤتمر المعني بيوغوسلافيا، أو على بعثة المراقبة التابعة للجماعة اﻷوروبية، وأن تتعاون الدول واﻷطراف والجهات المعنية اﻷخرى تعاونا كاملا مع قوة الحماية، والمؤتمر المعني بيوغوسلافيا، والبعثة، واحترام حريتها في الحركة وسلامة أفرادها احتراما تاما؛

5. Further decides that the measures set out in paragraph 4 above shall not apply to cases of medical emergency or to flights of aircraft carrying food, medicine, or supplies for essential humanitarian needs, as approved in advance by the Committee created pursuant to resolution 864 (1993);
٥ - يقرر كذلك ألا تنطبق التدابير الواردة فــي الفقرة ٤ أعلاه على حالات الطوارئ الطبية ولا على رحلات الطائرات التي تنقل أغذية أو أدوية أو لوازم الاحتياجات اﻹنسانية اﻷساسية، التي توافق عليها مسبقا اللجنة المنشأة عملا بالقرار ٨٦٤ )١٩٩٣(؛

٥ - يقرر كذلك ألا تنطبق التدابير الواردة في الفقرة ٤ أعــلاه علــى حــالات الطـوارئ الطبيـة ولا على رحلات الطائرات التي تنقل أغذية أو أدوية أو لوازم الاحتياجات اﻹنسانية اﻷساسية، التي توافق عليها مسبقا اللجنة المنشأة عملا بالقرار ٨٦٤ )١٩٩٣(؛

(b) Prevent the entry into or the transit through their territories of these individuals, provided that nothing in this paragraph shall oblige any State to deny entry into or require the departure from its territories of its own nationals and this paragraph shall not apply where entry or transit is necessary for the fulfilment of a judicial process or the Committee determines on a case-by-case basis only that entry or transit is justified.
الفقرة الفرعية (ب) منع دخول هؤلاء الأفراد إلى أراضيها أو مرورهم العابر بها، على ألا يلزم أي شيء في هذه الفقرة أي دولة برفض دخول رعاياها إلى أراضيها أو مطالبتهم بمغادرتها؛ وعلى ألا تنطبق هذه الفقرة حيث يكون الدخول أو المرور العابر ضروريا للإيفاء بعملية قضائية أو عندما تحدد اللجنة، على أساس كل حالة على حدة فقط، أن الدخول أو المرور العابر له ما يبرره؛

2 - منع دخول هؤلاء الأفراد إلى أراضيها أو مرورهم العابر بها، على ألا يلزم أي شيء في هذه الفقرة أي دولة برفض دخول رعاياها إلى أراضيها ومطالبتهم بمغادرتها؛ وعلى ألا تنطبق هذه الفقرة حيث يكون الدخول أو المرور العابر ضروريا للإيفاء بعملية قضائية أو عندما تحدد اللجنة، على أساس كل حالة على حدة فقط، أن الدخول أو المرور العابر له ما يبرره.

As mentioned in the Joint Declaration, exceptions should apply only where there is a risk of substantial harm to the protected interest and where that harm is greater than the overall public interest in having access to the information.
فعلى نحو ما ذُكر في الإعلان المشترك، ينبغي ألا تنطبق الاستثناءات إلا عندما يكون هناك خطر بإلحاق ضرر جسيم بمصلحة خاضعة للحماية وعندما يكون ذلك الضرر أكبر من المصلحة العامة الكلية في الوصول إلى المعلومات.

Nonetheless, article 14, paragraph 1, should not apply.
