The State party should intensify efforts to improve the conditions of detention in places of deprivation of liberty, including detention facilities for inmates serving life terms, bringing them into line with international standards, inter alia the Standard Minimum Rules for the Treatment of Prisoners (Economic and Social Council resolutions 663C (XXIV) and 2076 (LXII)).

Being a member of the Subcommittee/CPT and an expert assistant of the Commissioner for Human Rights, CoE, I participated in number of regular/ad-hoc visits to places of deprivation of liberty in Europe, Latin America, Africa and Asia.

However, in too many countries, no public monitoring exists or external monitors rarely have access to all places of deprivation of liberty, and the preconditions for effective monitoring, such as unannounced visits and confidential interviews with detainees, are often not granted.

The State party should continue its efforts to bring the conditions of detention in places of deprivation of liberty into line with the appropriate provisions of the Standard Minimum Rules for the Treatment of Prisoners, which are currently under revision, in particular by:

In this context, it recalls article 2 of the national law whereby the NPM should complement rather than replace existing systems of oversight, such as the Ombudsman and NGOs, which have mandates to visit places of deprivation of liberty.

22. The SPT recommends that whilst exercising its own visiting mandate, the NPM cooperate with the other existing mechanisms which monitor places of deprivation of liberty in order to seek possible synergies, including in the context of monitoring houses for the elderly.
