"
85- واتساقا مع نهج تحديد أنواع الطعن التي يمكن التنازل عنها تحديداً عاماً، ولتوضيح الاستثناءات منها، اقتُرح اعتماد نص على غرار ما يلي: " باعتماد هذه القواعد، يتنازل الأطراف عن حقهم في أي شكل من أشكال الاستئناف أو المراجعة أو الطعن أمام أي محكمة أو هيئة مختصة، باستثناء طلب إلغاء قرار التحكيم. "

However, their existence would be a powerful argument that could be submitted by the Executive Secretary to any court hearing such a claim that the appropriate forum for the settlement of disputes under the Kyoto Protocol is in Germany and according to the Headquarters Agreement and the decisions of the COP/MOP, as acknowledged in writing by the plaintiff.

ولتبديد هذا الشاغل، اقتُرح إعادة صياغة الجملتين الأخيرتين وفق ما يلي: " وتُعتبر الأطراف قد تنازلت عن حقها في أي شكل من أشكال الاستئناف أو المراجعة أو الطعن أمام أي محكمة أو هيئة مختصة أخرى، ما دام يمكن إجراء ذلك التنازل بصورة صحيحة.

Another proposal was made to provide: " Insofar as such waiver can be validly made, the parties shall be deemed to have waived their right to any form of appeal, review or recourse to any court or other competent authority, save that the right to apply for setting aside an award may be waived only if the parties specifically agree. "
وقُدّم اقتراح آخر للنص وفقا لما يلي: " وتُعتبر الأطراف قد تنازلت عن حقها في أي شكل من أشكال الاستئناف أو المراجعة أو الطعن أمام أي محكمة أو هيئة مختصة أخرى، ما دام يمكن إجراء ذلك التنازل بصورة صحيحة، ولكن لا يجوز التنازل عن الحق في طلب إلغاء قرار التحكيم ما لم تتفق الأطراف على ذلك تحديدا. "

65. Criminal prosecution before a court is possible only on the basis of an indictment filed by the prosecutor.
65- ولا يمكن إجراء محاكمة جنائية أمام أي محكمة إلاّ بناء على لائحة اتهام مقدمة من وكيل النيابة.

However, the Commission cannot inquire into any complaint relating to any allegation of the infringement of human rights which is the subject matter of any proceedings pending in any court or which has finally determined by any court.
