3.4 The author asserts that article 9, paragraph 1, of the Covenant has been violated because the State party was under an obligation to take the necessary steps to ensure his personal safety and never did so, despite being aware of the numerous instances of harassment and provocation and the death threats the author was receiving, some from the military and police authorities themselves.
3-4 ويؤكد صاحب البلاغ حدوث انتهاك للفقرة 1 من المادة 9 من العهد لأن الدولة الطرف كانت ملزَمة باتخاذ التدابير الضرورية لضمان أمنه الشخصي وهو ما لم تقم به قط، وذلك فيما كانت على علم بالمضايقات العديدة والاستفزازات والتهديدات بالقتل التي كان صاحب البلاغ هدفاً لها، من قبل جهات منها سلطات الجيش والشرطة نفسها.

Thus -- over and above the procedures relating to refugee, asylum or stateless status -- consideration must be given to the large number of cases in which the expulsion decision would inevitably have an impact on the future living conditions of the individual or on his or her personal security.
ومن ثم، وعلاوة على الإجراءات المتعلقة بمركز اللاجئين أو طالبي اللجوء أو عديمي الجنسية، لا بد من إيلاء الاعتبار إلى العدد الكبير من الحالات التي سيخلّف فيها قرار الطرد آثارا على الأحوال المعيشية للشخص أو على أمنه الشخصي في المستقبل.

In the circumstances, and in the absence of any explanations from the State party in this respect, the Committee concludes that the author's right to security of person, under article 9, paragraph 1, in conjunction with article 2, paragraph 3 of the Covenant has been violated.
وفي ظل هذه الظروف، وبما أن الدولة الطرف لم تقدم أية إيضاحات في هذا الصدد، تخلص اللجنة إلى أن حق صاحب البلاغ في أمنه الشخصي الذي تكفله الفقرة 1 من المادة 9، مقترنة بالفقرة 3 من المادة 2 من العهد، قد انتُهك.

For these reasons, and because the statements in question were made by the Head of State acting under immunity enacted by the State party, the Committee takes the view that the State party is responsible for a violation of the author's right to security of person under article 9, paragraph 1, of the Covenant.

57- وقد يشكل إبعاد الفرد إلى بلد مع وجود أسباب حقيقية تدعو إلى الاعتقاد بأنه سيواجه مخاطر حقيقية بحدوث انتهاكات جسيمة لحريته أو أمنه الشخصي في ذلك البلد، مثل الاحتجاز التعسفي المطول، معاملة لا إنسانية على النحو الذي تحظره المادة 7 من العهد().

To prevent torture, sexual violence or ill-treatment or harassment of persons in custody and to reaffirm every person's inherent rights to security of person and dignity, detained persons should be separated by gender, at least for the purpose of housing and personal functions, and protection against violence and harassment should be established in the rules and practices of detention facilities.
