It has thus been suggested that Iraq is responsible for damage to the environment caused by acts of Iraqi servicemen, even if those servicemen were acting in a wholly private capacity, such as private soldiers looting and destroying property in their retreat. In practice, claimants are only required to prove the direct causal link between the environmental loss and the invasion and occupation of Kuwait, and the value of the alleged loss.

Applying this conclusion, as well as the Governing Council's conclusion that Iraq is liable for losses arising from contracts that were interrupted as a direct result of its invasion and occupation of Kuwait, the Panel finds that Landmark's claim is compensable in principle.

Paragraph 35(e) of Governing Council decision 7 provides further guidance by stating that Iraq is liable for " losses or expenses " resulting from " depletion of or damage to natural resources. "

[t]he breakdown of civil order in Kuwait or Iraq during " the period 2 August 1990 to 2 March 1991.
12- وفيما يتصل بخسائر الممتلكات الناجمة عن انهيار النظام العام الراجع إلى غياب السلطة القانونية إثر انسحاب العراق من الكويت، يلاحظ الفريق أن الفقرة 34 (د) من المقرر الذي اتخذه المجلس تنص على أن العراق مسؤول عن " أي خسارة ناتجة عن ... انهيار النظام العام في الكويت أو في العراق أثناء " الفترة الممتدة من 2 آب/أغسطس 1990 إلى 2 آذار/مارس 1991.
