In its decision on the Akwanga case, the Committee has missed a clear opportunity to declare that the trial of civilians by military courts is incompatible with article 14 of the Covenant and to correct this regressive aspect of human rights law.

In its general comment No. 13 (1984) on the right to a fair trial, the Human Rights Committee established that the trying of civilians by military courts should be of an exceptional nature, and recalled the duty of military courts to respect the guarantees stipulated in article 14 of the Covenant.

Both the Commission and the Inter-American Court of Human Rights have held that the trying of civilians by military tribunals conflicts with the articles of the American Convention on Human Rights, which guarantee the right to be tried by an independent and impartial court and the right to a fair trial.

وقد أشارت اللجنة المعنية بحقوق الإنسان في الفقرة 22 من تعليقها العام رقم 32 إلى أن محاكمة المدنيين أمام محاكم عسكرية قد يثير مشاكل خطيرة فيما يتعلق بإقامة العدل بصورة منصفة ومحايدة ومستقلة.

The Committee also notes that the trial of civilians in military or special courts may raise serious problems as far as the equitable, impartial and independent administration of justice is concerned.
كما تلاحظ اللجنة أن محاكمة المدنيين أمام محاكم عسكرية أو خاصة قد يثير مشاكل خطيرة فيما يتعلق بإقامة العدل بصورة منصفة ومحايدة ومستقلة.

Furthermore, the Committee clarified that trials of civilians by military or special courts should be exceptional, in other words they should be limited to cases where the State party to the Covenant can show that resorting to such trials is necessary and justified by objective and serious reasons and where with regard to the specific class of individuals and offences at issue the regular civilian courts are unable to undertake the trials.
