In its decision Assembly/AU/Dec.335 (XVI), the Assembly of the African Union, while reiterating its commitment to combat impunity, had called upon all concerned States to respect international law, particularly with regard to the immunity of State officials, when applying the principle of universal jurisdiction and to seek a durable solution to its abuse.

48. The Special Rapporteur would like to remind Governments that, in 2009, the General Assembly in its resolution 63/184 called upon all States " to respect the human rights and the inherent dignity of migrants and to put an end to arbitrary arrest and detention and, where necessary, to review detention periods in order to avoid excessive detention of irregular migrants, and to adopt, where applicable, alternative measures to detention " .
48- يود المقرر الخاص أن يذكر الحكومات بأن الجمعية العامة قد أهابت بجميع الدول عام 2009 في قرارها 63/184 " أن تحترم حقوق الإنسان والكرامة الأصيلة للمهاجرين، وأن تضع حداً للاعتقال والاحتجاز التعسفيين، وأن تعيد النظر، حسب الاقتضاء، في فترات الاحتجاز تفادياً لاحتجاز المهاجرين غير القانونيين لفترات طويلة للغاية، وأن تتخذ، عند الاقتضاء، تدابير بديلة للاحتجاز " .
