82. In resolution 1989/64 the Economic and Social Council recommended that States strengthen the protection of the rights of those facing the death penalty by, inter alia, eliminating the death penalty for persons suffering from mental retardation or extremely limited mental competence.
82- وفي القرار 1989/64 أوصى المجلس الاقتصادي والاجتماعي بأن تعزز الدول حماية حقوق أولئك الذين يواجهون عقوبة الإعدام بعدة طرق من بينها إلغاء عقوبة الإعدام بالنسبة للأشخاص الذين يعانون من التخلف العقلي أو الضعف البالغ في القدرة العقلية.

The Special Rapporteur wishes to point out that in resolution 1989/64 the Economic and Social Council recommended that States strengthen the protection of the rights of those facing the death penalty by eliminating the death penalty for persons suffering from mental handicap or extremely limited mental capacity.
62- وتود المقررة الخاصة أن تشير الى أن المجلس الاقتصادي والاجتماعي قد أوصى في القرار 1989/64 بأن تقوم الدول بتعزيز حماية حقوق أولئك الذين يواجهون عقوبة الإعدام عن طريق إلغاء عقوبة الإعدام بالنسبة للأشخاص الذين يعانون من التخلف العقلي أو الأهلية العقلية المحدودة الى درجة كبيرة.

Moreover, the Safeguards guaranteeing protection of the rights of those facing the death penalty (Council resolution 1984/50) stipulate that the death penalty shall not be carried out on persons who have become insane.

The Special Rapporteur wishes to stress that in resolution 1989/64 the Economic and Social Council also recommended that States strengthen the protection of the rights of those facing the death penalty by eliminating the death penalty for persons suffering from mental handicap or extremely limited mental capacity.

The latest quinquennial report of the Secretary-General on capital punishment and the implementation of safeguards guaranteeing protection of the rights of those facing the death penalty identifies an " encouraging trend towards abolition and restriction of the use of capital punishment in most countries " .
وفي التقرير الأخير الذي يُقدمه الأمين العام كل خمس سنوات عن عقوبة الإعدام وتنفيذ الضمانات التي تكفل حماية حقوق أولئك الذين يواجهون عقوبة الإعدام يُحدد قول بأن " هناك اتجاهاً مشجعاً نحو إلغاء عقوبة الإعدام وتقييد تنفيذها في معظم البلدان " .

In its resolution 1989/64, on the implementation of the aforementioned safeguards, the Economic and Social Council recommended that States strengthen further the protection of the rights of those facing the death penalty by eliminating it for persons suffering from mental retardation or extremely limited mental competence, whether at the stage of sentence or execution.
وأوصى المجلس الاقتصادي والاجتماعي في قرراه 1989/64 المتعلق بتنفيذ الضمانات المذكورة أعلاه، الدول بزيادة تعزيز حماية حقوق أولئك الذين يواجهون عقوبة الإعدام بإلغائها بالنسبة للأشخاص الذين يعانون تخلفا عقليا أو من لهم قدرات عقلية محدودة جدا، سواء كان ذلك في مرحلة إصدار الحكم أو تنفيذه.

In this regard, the Special Rapporteur shares the view expressed by the Economic and Social Council in its resolution 1989/64 of 24 May 1989 entitled “Implementation of the safeguards guaranteeing protection of the rights of those facing the death penalty”, recommending that Member States introduce mandatory appeals or review with provisions for clemency or pardon in all cases of capital offence.
وفي هذا الصدد فإن المقررة الخاصة تشاطر المجلس الاقتصادي والاجتماعي على الرأي الذي أعرب عنه في القرار 1989/64 بتاريخ 24 أيار/مايو 1989 والمعنون " تنفيذ الضمانات التي تكفل حماية حقوق أولئك الذين يواجهون عقوبة الإعدام " ، والذي أوصى فيه المجلس، الدول الأعضاء بالنص على وجوب الاستئناف أو إعادة النظر مع توفير إمكانيات طلب الرأفة أو العفو في جميع قضايا الجرائم التي يعاقب عليها بالإعدام.

17. In his report to the sixty-second session of the Commission on Human Rights in March 2006, the Special Rapporteur on extrajudicial, summary or arbitrary executions again considered the issue of lack of transparency in relation to the death penalty, and its impact on those facing the death penalty, their families, public debate and effective monitoring.
17- ونظر المقرر الخاص المعني بحالات الإعدام خارج نطاق القضاء أو بإجراءات موجزة أو تعسفاً من جديد، في تقريره إلى الدورة الثانية والستين للجنة حقوق الإنسان في آذار/مارس 2006()، في مسألة الافتقار إلى الشفافية فيما يتصل بعقوبة الإعدام وتأثير ذلك على أولئك الذين يواجهون عقوبة الإعدام وأسرهم، والنقاش العام، والرصد الفعلي.
