It had also been proposed at the outset by the International Law Commission's first Special Rapporteur on the succession of States in respect of treaties, Sir Humphrey Waldock, who based his considerations, in particular, on a concern for respecting the actual intention of the successor State by avoiding the creation of an irreversible situation and on a number of elements of practice that seemed to support such a presumption.
