ويحظر بشكل قاطع استغلال الدخول أو الخروج أو المرور العابر أو الإقامة في فييت نام من أجل انتهاك القانون " ؛ وتنص المادة 1 (3) كذلك على أنه " في الحالات التي تنص فيها اتفاقيات أو معاهدات دولية تلتزم بها فييت نام على شيء خلاف ذلك، فيما يتعلق بدخول الأجانب إلى فييت نام وخروجهم منها ومرورهم العابر بها وإقامتهم فيها، ترجح أحكام هذه الاتفاقيات والمعاهدات الدولية " .
