Under article 138 of the Criminal Code, rape, i.e. sexual intercourse involving the use or threat of violence against the victim or her relatives, or taking advantage of the helpless state of the victim, is punishable by deprivation of liberty for a period of between 3 and 20 years, depending on the existence of aggravating circumstances, as defined in the law, or the death sentence.
