Article 6 complements the provisions of article 4 by requesting from States parties that they ensure to everyone within their jurisdiction effective protection and remedies against acts of racial discrimination as well as just and adequate reparation or satisfaction for any damage suffered as a result of such discrimination.
وتستكمل المادة 6 أحكام المادة 4 حيث تطلب من الدول الأطراف أن تكفل لكل إنسان يعيش ضمن ولايتها القضائية حماية فعالة من أفعال التمييز العنصري وسبل انتصاف فعالة فيما يتعلق بذلك، وتعويضاً عادلاً ومناسباً أو ترضية عادلة ومناسبة عن أي ضرر لحقه نتيجة لهذا التمييز.

However, it recommended that the State party take the necessary measures to ensure that victims of racial discrimination seeking just and adequate reparation or satisfaction, including economic compensation, would have their claims considered with due respect for situations where the discrimination had not resulted in any physical damage but humiliation or similar suffering.

Article 6 of CERD obliges States parties to provide for effective remedies and for the right to seek just and adequate reparation or satisfaction for damage resulting from acts of racial discrimination.

120. In connection with article 6 of the Convention, the Committee requests that information be provided on the availability of the right to seek from the courts just and adequate reparation or satisfaction for any damage suffered as a result of racial discrimination.

426. With respect to article 6 of the Convention, there is concern at the lack of legislative provisions to implement the right to just and adequate reparation or satisfaction for any damage suffered as a result of acts of racial discrimination.
٤٢٦ - وفيما يتعلق بالمادة ٦ من الاتفاقية هناك شعور بالقلق لعدم وجود اﻷحكام التشريعية اللازمة ﻹعمال الحق في جبر عادل ومناسب أو ترضية عادلة مناسبة ﻷي ضرر يلحق باﻹنسان نتيجة ﻷي عمل من أعمال التمييز العنصري.

To ensure that everyone within a State's jurisdiction, including victims of racism, racial discrimination, xenophobia and related intolerance, enjoys access to justice, as well as to appropriate State institutions and mechanisms in order to seek recognition of wrong-doing and just, fair and adequate reparation or satisfaction for any damage suffered.
ضمان إمكانية وصول جميع الأشخاص داخل ولاية الدولة القضائية، بمن فيهم ضحايا العنصرية والتمييز العنصري وكره الأجانب وما يتصل بذلك من تعصب، إلى العدالة وكذا الوصول إلى المؤسسات والآليات الملائمة التابعة للدولة من أجل الحصول على اعتراف بالجرم، وعلى جبر أو ترضية عادلة ومنصفة وكافية تعويضاً عن أي ضرر.

It also recommended that Slovakia intensify efforts to ensure to everyone within its jurisdiction effective protection against any act of racial discrimination, as well as the right to seek just and adequate reparation or satisfaction for any damage suffered as a result of such discrimination.
كما أوصت سلوفاكيا بمضاعفة جهودها لكفالة حماية فعالة لكل من هم ضمن نطاق ولايتها القضائية من كل عمل من أعمال التمييز العنصري، وكذلك الحق في التماس تعويض مناسب أو ترضية عادلة عن أي ضرر يقع نتيجة لهذا التمييز.

Article 6 focuses on securing effective protection and remedies for victims of racial discrimination and the right to seek " just and adequate reparation or satisfaction " for damage suffered.

205. The Committee recommends that comprehensive information be provided on legislative and other measures adopted by the State party to comply with provisions of article 6 of the Convention and on the availability of the right to seek from the courts just and adequate reparation or satisfaction for any damage suffered as a result of racial discrimination.
٢٠٥ - وتوصي اللجنة بتقديم معلومات شاملة عن التدابير التشريعية وغيرها من التدابير التي اتخذتها الدولة الطرف امتثالا ﻷحكام المادة ٦ من الاتفاقية، وعن توافر الحق في الرجوع إلى المحاكم للحصول على جبر عادل مناسب أو ترضية عادلة مناسبة ﻷي أضرار تلحق نتيجة التمييز العنصري.

193. Urge States to adopt the necessary measures to ensure the rights of victims, in particular the right to an effective judicial remedy and to seek just and adequate reparation or satisfaction for acts of racism, racial discrimination, xenophobia and related intolerance, and effective measures designed to prevent the resurgence of such acts;
193- نحث الدول على اتخاذ التدابير اللازمة لضمان حقوق الضحايا، ولا سيما الحق في الانتصاف القضائي الفعال والتماس جبر أو ترضية عادلة وكافية عن أعمال العنصرية والتمييز العنصري وكره الأجانب وما يتصل بذلك من تعصب، واتخاذ تدابير فعالة لمنع تكرار هذه الأعمال؛

(i) People of African descent can seek protection and remedies effectively, through the competent national tribunals and other State institutions, against any acts of racial discrimination, and seek just and adequate reparation or satisfaction from such tribunals for any damage suffered as a result of racial discrimination;
(ط) تمكين السكان المنحدرين من أصل أفريقي من التماس الحماية والوصول إلى سبل للانتصاف على نحو فعَّال، من خلال المحاكم الوطنية المختصة وغيرها من مؤسسات الدولة، من أي فعل من أفعال التمييز العنصري، والتماس سبل جبر تعويضات أو ترضية عادلة وكافية عن أية أضرار تكبدوها نتيجة للتمييز العنصري؛

(a) Assuring for people of African descent effective protection and remedies, through the competent national tribunals and other State institutions, against any acts of racial discrimination, as well as the right to seek from such tribunals just and adequate reparation or satisfaction for any damage suffered as a result of such discrimination;
(أ) ضمان الحماية وسبل الانتصاف الفعالتين للمنحدرين من أصل أفريقي، من خلال الرجوع إلى المحاكم الوطنية وغيرها من مؤسسات الدولة، بصدد أي عمل من أعمال التمييز العنصري، فضلاً عن حق التماس تعويض عادل مناسب أو ترضية عادلة مناسبة عن أي ضرر ناجم عن هذا التمييز()؛

The Committee reaffirms that the provisions of article 6 of the Convention are mandatory and that the Government of India should adopt legal provisions making it easier for individuals to seek from the courts just and adequate reparation or satisfaction for any damage suffered as a result of acts of racial discrimination, including acts of discrimination based on belonging to a caste or a tribe.
٣٧٠ - وتؤكد اللجنة من جديد أن أحكام المادة ٦ من الاتفاقية هي أحكام ملزمة وأنه ينبغي لحكومة الهند اعتماد نصوص قانونية تيسر على اﻷفراد أن يلتمسوا من المحاكم تعويضا عادل ومناسبا أو ترضية عادلة ومناسبة عن أي ضرر يلحقهم نتيجة ﻷعمال التمييز العنصري، بما في ذلك أعمال التمييز على أساس الانتماء الى طائفة أو قبيلة.

With regard to article 6 of the Convention, additional information was requested on the right of victims to seek adequate reparation or satisfaction for damage suffered as a result of discrimination; on the way in which the right of recourse to the courts was enjoyed by citizens of States with which Kuwait had not concluded bilateral agreements; and how many cases had actually been brought before the judicial authorities and settled by them.
٢٦٧ - وفيما يتعلق بالمادة ٦ من الاتفاقية، طلب مزيد من المعلومات عن حق الضحايا في التماس تعويض مناسب أو ترضية عادلة عن أي ضرر يلحق بأولئك الضحايا كنتيجة للتمييز؛ وعن الطريقة التي يمكن بها التمتع بحق الرجوع الى المحاكم بالنسبة لمواطني الدول التي لم تبرم معها الكويت اتفاقات ثنائية؛ وعن عدد القضايا التي عرضت على السلطات القضائية وبتت فيها تلك السلطات.

" تكفل الدول الأطراف لكل إنسان داخل في ولايتها حق الرجوع إلى المحاكم الوطنية وغيرها من مؤسسات الدولة المختصة لحمايته ورفع الحيف عنه على نحو فعال بصدد أي عمل من أعمال التمييز العنصري يكون انتهاكاً لما له من حقوق الإنسان والحريات الأساسية ويتنافى مع هذه الاتفاقية، وكذلك حق الرجوع إلى المحاكم المذكورة التماساً لتعويض عادل مناسب أو ترضية عادلة مناسبة عن أي ضرر لحقه كنتيجة لهذا التمييز " .
