11 - ويقترح لدى ترشيح الحكومات، وانتخاب المجلس، أعضاء في الهيئة، المراعاة الواجبة لما قد يترتب من فقدان الأهلية على شغل أي منصب أو مزاولة أي نشاط يمكن أن يكون ماسا بحيدتهم في ممارسة مهامهم.

2. Where such acts have caused the loss of human life or other grave consequences, they shall be punishable by restriction of freedom for up to five years, or imprisonment for up to five years, with deprivation of the right to occupy certain positions or engage in certain activities for up to three years.
2- وتخضع هذه الأفعال إذا تسببت في زهق أرواح بشرية أو في إحداث عواقب وخيمة أخرى لعقوبة تقييد الحرية لمدة تصل إلى خمس سنوات أو للحبس لمدة تصل إلى خمس سنوات مع الحرمان من الحق في شغل مناصب معينة أو مزاولة أنشطة معينة لمدة تصل إلى ثلاث سنوات.

Furthermore, as indicated above, article 9 of the 1961 Convention requires that members of the INCB, during their term of office, must not hold " any position or engage in any activity " which would be incompatible with their status.
