وعلى وجه التحديد، يقضي هذا الحكم بأن تسعى الدول الأطراف إلى وضع تدابير ونظم تلزم الموظفين العموميين بأن يُفصحوا للسلطات المعنيَّة عن أشياء منها ما لهم من أنشطة خارجية وعمل وظيفي واستثمارات وموجودات وهبات أو منافع كبيرة قد تفضي إلى تضارب في المصالح مع مهامهم كموظفين عموميين.

Article 8, paragraph 5, of the Convention requires States parties to take measures for public officials to make declarations to appropriate authorities regarding, inter alia, their outside activities, employment, investments, assets and substantial gifts or benefits from which a conflict of interest may result with respect to their functions as public officials.
وتقضي الفقرة 5 من المادة 8 من الاتفاقية بأن تتخذ الدول الأطراف تدابير تلزم الموظفين العموميين بأن يفصحوا للسلطات المعنية عن أشياء معينة منها ما لهم من أنشطة خارجية وعمل وظيفي واستثمارات وموجودات وهبات أو منافع كبيرة قد تفضي إلى تضارب في المصالح مع مهامهم كموظفين عموميين.

While most of these are exclusively value based, others also contain specific requirements for public officials to declare their outside activities, employment, investments, assets and substantial gifts or benefits from which a conflict of interest might result with respect to their functions.
ورغم أن معظم هذه المدونات مستمدة على وجه الحصر من القيم، فثمة مدونات أخرى تشتمل أيضا على شروط محددة تُفرض على الموظفين العموميين الإفصاح عما لهم من أنشطة خارجية وعمل وظيفي واستثمارات وموجودات وهبات أو منافع كبيرة قد تفضي إلى تضارب في المصالح مع مهامهم.

It further prescribes measures to facilitate the reporting of acts of corruption, and measures requiring personnel to declare outside activities, employment, investment and assets, gifts or benefits from which a conflict of interest may result.
كما تنص على تدابير لتسهيل الإبلاغ عن أعمال الفساد وتدابير تلزم الموظفين بالكشف عن كل ما قد يفضي إلى تضارب في المصالح من أنشطة أو أعمال وظيفية خارجية يمارسونها أو استثمارات أو موجودات يملكونها أو هدايا أو منافع يحصلون عليها.

وفي الفقرة الثانية، أدخلت العبارة " إعطاء أو تلقِّي مبالغ مالية أو منافع التماسا للحصول على موافقة شخص له سيطرة على شخص آخر " لكي تبيّن شكلا مشددا للعقوبة من أشكال هذا الجُرم.

5. Each State Party shall endeavour, where appropriate and in accordance with the fundamental principles of its domestic law, to establish measures and systems requiring public officials to make declarations to appropriate authorities regarding, inter alia, their outside activities, employment, investments, assets and substantial gifts or benefits from which a conflict of interest may result with respect to their functions as public officials.
5- تسعى كل دولة طرف، عند الاقتضاء ووفقا للمبادئ الأساسية لقانونها الداخلي، إلى وضع تدابير ونظم تلزم الموظفين العموميين بأن يفصحوا للسلطات المعنية عن أشياء منها ما لهم من أنشطة خارجية وعمل وظيفي واستثمارات وموجودات وهبات أو منافع كبيرة قد تفضي إلى تضارب في المصالح مع مهامهم كموظفين عموميين.

It tackles the first objective of such systems and complements the provision of article 8, paragraph 5, which requires that States parties endeavour to establish measures and systems requiring public officials to make declarations regarding, inter alia, their outside activities, employment, investments, assets and substantial gifts or benefits from which a conflict of interest may result with respect to their functions as public officials.
وهي تعالج الهدف الأول من هذه النظم وتستكمل حكم الفقرة 5 من المادة 8، الذي يقضي بأن تسعى الدول الأطراف إلى وضع تدابير ونظم تلزم الموظفين العموميين بأن يقدِّموا إقرارات عن أشياء منها ما لهم من أنشطة خارجية وعمل وظيفي واستثمارات وموجودات وهبات أو منافع كبيرة قد تفضي إلى تضارب في المصالح مع مهامهم كموظفين عموميين.

This is in line with article 8 (5) of the United Nations Convention against Corruption, referring to: " measures and systems requiring public officials to make declarations to appropriate authorities regarding, inter alia, their outside activities, employment, investments, assets and substantial gifts or benefits from which a conflict of interest may result " .
وهذا يتمشى مع الفقرة (5) من المادة 8 من اتفاقية الأمم المتحدة لمكافحة الفساد التي تشير إلى: " تدابير ونظم تلزم الموظفين العموميين بأن يفصحوا للسلطات المعنية عن أشياء منها ما لهم من أنشطة خارجية وعمل وظيفي واستثمارات وموجودات وهبات أو منافع كبيرة قد تفضي إلى تضارب في المصالح " .

(v) Governments be extremely vigilant in ensuring that parents and guardians accompanying minors have not received payments or benefits to give their consent to allow minors under their care to be exploited.
(ت) ينبغي للحكومات توخي الحذر الشديد في ضمان عدم حصول الآباء و الأوصياء الذين يرافقون أطفالاً قاصرين على مبالغ أو منافع حتى يوافقوا على السماح باستغلال الأطفال الموجودين في رعايتهم.

" Unlawful means " includes, among others, kidnapping, fraudulent or coerced consent, the giving or receipt of unlawful payments or benefits to achieve the consent of the parents, persons or institution having care of the child, or any other means unlawful in either the State of the minor's habitual residence or the State party where the minor is located.
وتشمل " الوسائل غير المشروعة " ، في جملة أمور، الخطف، والموافقة الاحتيالية أو المنتزعة باﻹكراه، وتقديم أو تلقي دفوعات أو منافع غير مشروعة للحصول على موافقة الوالدين أو اﻷشخاص أو المؤسسات التي ترعى الطفل، أو بأية وسائل غير مشروعة أخرى إما في دولة إقامة القاصر المعتادة أو الدولة الطرف التي يتواجد فيها القاصر.
