Discrimination includes all forms of discrimination based, inter alia, on race, colour, sex, age, descent, disability, language, religion or conviction, political or other opinion, national ethnic or social origin, economic position, property, marital status, birth, citizenship, residence or other status.

The Committee notes with satisfaction the adoption of the constitution in 1994, which includes provisions on fundamental rights and freedoms enshrining, inter alia, the principle of equality and non-discrimination on grounds of race, nationality, social origin, colour, sex, language, religion, political or other opinion, property, birth or other status.

However, such indirect discrimination can only be said to be based on the grounds enumerated in article 26 of the Covenant if the detrimental effects of a rule or decision exclusively or disproportionately affect persons having a particular race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.

Moreover, the obligation to guarantee that the right to water is enjoyed without discrimination prohibits any discrimination on the grounds of race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status, which has the intention or effect of nullifying or impairing the equal enjoyment or exercise of the right to water.

Article 143 of the Criminal Code specifies criminal liability for a direct or indirect violation of human or civil rights and freedoms that is based on nationality, race, sex, language, religion, political or other views, social origin, or property or other status and that has damaged the citizen's lawful interests.
21 - وتحدِّد المادة 143 من القانون الجنائي المسؤولية الجنائية المترتبة على أي انتهاك مباشر أو غير مباشر لحقوق الإنسان أو الحقوق المدنية والحريات على أساس القومية أو العنصر أو نوع الجنس أو اللغة أو الديانة أو الآراء السياسية وغيرها من الآراء، أو الأصل الاجتماعي أو وضع الملكية أو وضع آخر يمس المصالح المشروعة للشخص.

The State party should take appropriate measures to ensure that its definition of discrimination prohibits all forms of discrimination as set out in the Covenant (race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status) and put in place effective mechanisms to provide access to justice and remedies in cases of violation of those rights.
