Paragraph 1 of article 24 (Protection of witnesses) requires States parties to take measures to provide effective protection from potential retaliation or intimidation for witnesses in criminal proceedings who give testimony concerning offences covered by the Convention.
59- وتقضي الفقرة 1 من المادة 24 (حماية الشهود) بأن تتخذ الدول الأطراف تدابير لتوفير حماية فعالة، من أي انتقام أو ترهيب محتمل، للشهود الذين يدلون في الإجراءات الجنائية بشهادة تتعلّق بجرائم مشمولة بالاتفاقية.

On the question of whether their domestic legal system enables the provision of protection from potential retaliation or intimidation for witnesses in criminal proceedings, many States reported that protection of witnesses was provided for under their legislation.
60- وفيما يتعلّق بالسؤال عما إذا كانت النظم القانونية الداخلية للدول توفّر الحماية للشهود الذين يدلون بشهادتهم في الإجراءات الجنائية من أي انتقام أو ترهيب محتمل، أفادت دول عديدة بأن تشريعاتها تنص على حماية الشهود.

Article 24, paragraph 3, of the Convention requires States parties to consider entering into agreements or arrangements with other States for the relocation of witnesses and victims, in order to ensure their physical protection from potential retaliation or intimidation.
67- تقضي الفقرة 3 من المادة 24 من الاتفاقية بأن تنظر الدول الأطراف في إبرام اتفاقات أو ترتيبات مع دول أخرى بشأن تغيير أماكن إقامة الشهود والضحايا، بما يكفل توفير الحماية المادية لهم من أي انتقام أو ترهيب محتمل.

66. Paragraph 1 of article 24 (Protection of witnesses) requires States parties to take measures to provide effective protection from potential retaliation or intimidation for witnesses in criminal proceedings who give testimony concerning offences covered by the Convention.

39. Article 24 of the United Nations Convention against Transnational Organized Crime places an obligation on each State party to take appropriate measures within its means to provide effective protection from potential retaliation or intimidation for witnesses in criminal proceedings who give testimony concerning offences covered by the Convention and, as appropriate, for their relatives and other persons close to them.
39- وتفرض المادة 24 من اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية التزاما على كل دولة طرف باتخاذ تدابير ملائمة في حدود إمكانياتها لتوفير حماية فعالة للشهود الذين يدلون في الإجراءات الجنائية بشهادة بخصوص الجرائم المشمولة بهذه الاتفاقية، وكذلك لأقاربهم وسائر الأشخاص الوثيقي الصلة بهم، حسب الاقتضاء، من أي انتقام أو ترهيب محتمل.

67. On the question of whether their domestic legal system enables the provision of protection from potential retaliation or intimidation for witnesses in criminal proceedings, 33 States reported that protection of witnesses was provided for under their legislation. Afghanistan, China (Macao SAR), Indonesia, Morocco, Myanmar and Sweden reported that the protection of witnesses was not provided for by their domestic legal system.
67- وفيما يتعلّق بالسؤال عما إذا كانت النظم القانونية الداخلية توفّر الحماية للشهود الذين يدلون بشهادتهم في الإجراءات الجنائية من أي انتقام أو ترهيب محتمل، أفادت 33 دولة() بأن تشريعاتها تنص على حماية الشهود وأفادت أفغانستان وإندونيسيا والسويد والصين (منطقة ماكاو الإدارية الخاصة) والمغرب وميانمار بأن نُظمها القانونية الداخلية لا تنص على توفير تلك الحماية.

Each State party shall take appropriate measures in accordance with its national law and within its means to provide effective protection from potential retaliation or intimidation for witnesses who give testimony concerning crimes set out in article 3 and, as appropriate, for their relatives and other persons close to them, without prejudice to the rights of the alleged offender, including the right to due process.
