استغلال الأطفال في المواد الإباحية يعني تصوير أي طفل [حقيقي] يمارس [ممارسة حقيقية أو بالمحاكاة] أنشطة جنسية صريحة [أو أي تصوير لجسم أو لجزء من جسم طفل تكون سمته الغالبة هي التصوير لإشباع الرغبة الجنسية].

With regard to article 2 (c) on the definition of child pornography, the representative of Portugal, on behalf of the European Union, said that the European Union understood the term " any representation " to mean visual representation.
23- وفيما يتعلق بالمادة 2(ج) بشأن تعريف استغلال الأطفال في المواد الإباحية قالت ممثلة البرتغال متكلمة بالنيابة عن الاتحاد الأوروبي بأن هذا الاتحاد يفهم المصطلح " أي تصوير " على أنه يعني التصوير المرئي.

28. The Committee recommends that the State party revise its penal code to ensure that its legislation on child pornography covers representation by whatever means, of a child engaged in real or simulated explicit sexual activities or any representation of the sexual parts of a child for primarily sexual purposes.
28- توصي اللجنة بأن تنقّح الدولة الطرف قانون العقوبات لتكفل أن تغطي تشريعاتها بشأن المواد الإباحية للأطفال التمثيل بأي طريقة كانت للطفل المشارك في أنشطة جنسية صريحة حقيقية أو تمثيلية أو أي تصوير للأعضاء الجنسية للطفل لأغراض جنسية في المقام الأول.

The Fundamental Law on Freedom of Expression provides (chap. 5, sect. 1) that any representation which is punishable under law shall be considered as an unlawful statement in modern media such as radio, television, etc. if it involves the same offences as mentioned in the Freedom of the Press Act.

30. Article 2 of the Optional Protocol defines child pornography as " any representation, by whatever means, of a child engaged in real or simulated explicit sexual activities or any representation of the sexual parts of a child for primarily sexual purposes " .
30 - تعرِّف المادة 2 من البروتوكول الاختياري استغلال الأطفال في المواد الإباحية بأنه " تصوير أي طفل بأي وسيلة كانت، يمارس ممارسة حقيقية أو بالمحاكاة أنشطة جنسية صريحة، أو أي تصوير للأعضاء الجنسية للطفل لإشباع الرغبة الجنسية أساساً " .

Declarations 8. The Committee is concerned that the State party's declaration on article 2 (c) of the Optional Protocol, wherein it states that it interprets the words " any representation " in the article as merely pertaining to " visual representation " of child pornography, hinders the full implementation of the Optional Protocol for dealing with all forms of child pornography.

27. Article 2 (c) of the Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography defines child pornography as " any representation, by whatever means, of a child engaged in real or simulated explicit sexual activities or any representation of the sexual parts of a child for primarily sexual purposes " .
27- ورد في الفقرة الفرعية (ج) من المادة 2 من البروتوكول الاختياري لاتفاقية حقوق الطفل المتعلق ببيع الأطفال وبغاء الأطفال واستغلال الأطفال في المواد الإباحية أن المقصود باستغلال الأطفال في المواد الإباحية هو: " تصوير أي طفل، بأي وسيلة كانت، يمارس ممارسة حقيقية أو بالمحاكاة أنشطة جنسية صريحة أو أي تصوير للأعضاء الجنسية للطفل لإشباع الرغبات الجنسية أساساً " .

24. The Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography defines child pornography as any representation, by whatever means, of a child engaged in real or simulated explicit sexual activities or any representation of the sexual parts of a child for primarily sexual purposes (art. 2 (c)).
24- ويعرِّف البروتوكول الاختياري للاتفاقية المتعلق ببيع الأطفال وبغاء الأطفال واستغلال الأطفال في المواد الإباحية، وذلك في الفقرة الفرعية (ج) من المادة 2، استغلال الأطفال في المواد الإباحية بأنه " تصوير أي طفل، بأي وسيلة كانت، يمارس ممارسة حقيقية أو بالمحاكاة أنشطة جنسية صريحة أو أي تصوير للأعضاء الجنسية للطفل لإشباع الرغبة الجنسية أساسا " .
