1- تتخذ كل دولة طرف إجراءات تشريعية أو إدارية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي.

19- يجب على الدول الأطراف، بموجب المادة 2 من الاتفاقية، أن تتخذ " إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .

3.3 The complainant also invokes article 2, paragraph 1, of the Convention, pursuant to which the State party should have taken all " effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " .

Article 2, paragraph 1, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment -- to which all States parties to the Optional Protocol must also be parties -- provides that, " Each State Party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " .
وتنص الفقرة 1 من المادة 2 من الاتفاقية، التي ينبغي لجميع الدول الأطراف في البروتوكول الاختياري أن تنضم إليها أيضاً، على واجب أن " تتخذ كل دولة طرف إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .

In the light of the information provided, the Committee considers that the State party has not given sufficient reasons, other than the mere assumption that he would try to abscond, to justify the initial pretrial detention of the author or its subsequent extension; nor has it explained why it could not take other measures to prevent his possible flight or why the detention order was not extended until months after the 2-year period had expired.
وفي ضوء المعلومات المقدمة، ترى اللجنة أن الدولة الطرف لم تقدم أسباباً كافية أكثر من مجرد افتراض أن يحاول صاحب البلاغ الهرب، لتبرير قرارها الأول باحتجازه رهن المحاكمة أو تمديد هذا القرار لاحقاً؛ كما لم توضح الدولة الطرف سبب عدم تمكنها من اتخاذ إجراءات أخرى لمنع احتمال هروب المتهم أو السبب في عدم تمديد أمر الاحتجاز لعدة أشهر بعد انتهاء فترة السنتين.

The State must enforce the prohibition on torture and illtreatment, which includes taking " effective legislative, administrative, judicial and other measures to prevent torture in any territory under its jurisdiction " .
ويجب قيام الدولة بإنفاذ الحظر المفروض على التعذيب وإساءة المعاملة، وهو ما يشمل اتخاذ " إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع التعذيب في أي إقليم يخضع لاختصاصها القضائي " (9).

Article 2, paragraph 1, of the Convention, to which all States Parties to the Optional Protocol must also be parties, provides that " Each State Party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " .

16. With regard to article 2 of the Convention, under which each State party has an obligation to take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction, acts of torture were already prohibited in the Kingdom's judicial and administrative legislation, as can be seen from the following:
16- إن ما تضمنته المادة 2 من الاتفاقية وهو " اتخاذ كل دولة طرف إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " مقررة في تشريع المملكة من قبل هذا النص ويتمثل في التشريعات القضائية والإدارية التي تمنع التعذيب في المملكة العربية السعودية، وأهمها:

With this procedure, the Committee seeks to advance the Convention's requirement that " each State party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture " (art. 2, para. 1) and the undertaking " to prevent ... other acts of cruel, inhuman or degrading treatment or punishment ... " (art. 16).
