2-10 وفي 14 شباط/فبراير 2011، رفع صاحب البلاغ طلباً إلى مجلس الهجرة يُشير فيه إلى وجود ظروف جديدة من شأنها أن توفر أسباباً معقولة تدعو إلى الاعتقاد بأنه سيواجه خطر التعذيب إذا أُعيد إلى أوزبكستان.

9.6 On the basis of all the information submitted, the Committee is of the view that the complainant has not provided sufficient evidence that would allow it to consider that he faces a foreseeable, real and personal risk of being tortured if he is expelled to his country of origin.
9-6 واستناداً إلى جميع المعلومات التي قُدمت، ترى اللجنة أن صاحب الشكوى لم يقدم أدلة كافية تجعلها تعتقد بأنه يواجه شخصياً خطراً متوقعاً وحقيقياً من تعرضه للتعذيب إذا أُعيد إلى بلده الأصلي.

9.7 As to the complainant's allegations that he would be at risk of torture in case of his deportation to Ukraine, the Committee has noted the State party's affirmation that given that the complainant is Belarusian national, he could not be expelled to Ukraine, but only to Belarus.
9-7 وفيما يتعلق بادعاءات صاحب الشكوى أنه يواجه خطر التعرض للتعذيب إذا أُعيد إلى أوكرانيا، تلاحظ اللجنة تأكيد الدولة الطرف أن صاحب الشكوى من مواطني بيلاروس ولا يمكن ترحيله إلى أوكرانيا، بل إلى موطنه بيلاروس فقط.

10.3 The Committee recalls its general comment No. 1 on the implementation of article 3 in the context of article 22, in which it states that it is obliged to assess whether there are substantial grounds for believing that the complainant would be in danger of being subjected to torture if he or she were returned to the country concerned.
10-3 وتذكر اللجنة بتعليقها العام رقم1 المتعلق بتطبيق المادة 3 في سياق المادة 22، والتي توضح في إطاره أنه ينبغي أن تحدد ما إذا كانت هناك أسباب وجيهة تحمل على الاعتقاد بأن صاحب الشكوى سيتعرض للتعذيب إذا أُعيد إلى البلد المعني.

For the abovementioned reasons, the Committee finds that the petitioner has not provided substantial grounds for believing that he would be in danger of being tortured were he to be returned to Sri Lanka and that such danger is personal and present.
وللأسباب السالفة الذكر، ترى اللجنة أن مقدم البلاغ لم يقدم أسباباً قوية تدعو للاعتقاد بأنه سيكون في خطر التعرض للتعذيب إذا أُعيد إلى سري لانكا وبأن هذا الخطر شخصي وقائم.
