3.2 The author submits that the imposition of a mandatory death sentence with no judicial discretion to impose a lesser sentence violates the prohibition of inhuman or degrading treatment or punishment under article 7 of the Covenant.

واستنتجت المحكمة العليا في الهند قضية " ميتو " أن الطائفة الواسعة من السيناريوهات تجيز فيها ظروف خاصة فرض عقوبة الإعدام على شخص ما، ولا تجيزه على شخص آخر في ظروف مماثلة في الظاهر، تُثبت استحالة إصدار عقوبة إعدام إلزامية على نحو عادل، وقد خلُصت المحكمة إلى ما يلي:

3.1 The author claims that a mandatory death penalty for all offences of a particular kind, such as murder, prevents the trial court from considering whether this exceptional form of punishment is appropriate in the circumstances of the case.
3-1 يدّعي صاحب البلاغ أن فرض عقوبة إعدام إلزامية في جميع الجرائم المصنفة ضمن فئة معينة، كجريمة القتل، يحول دون نظر محكمة العدل فيما إذا كان هذا الشكل الاستثنائي من أشكال العقاب مناسباً في ظروف القضية.

(c) Provide adequate funds for a prompt process for resentencing prisoners who have received a mandatory death penalty and ensure the right to seek pardon or commutation of the death sentence.
(ج) توفير القدر الكافي من الأموال للقيام على الفور بإعادة محاكمة السجناء الذين حكم عليهم بعقوبة إعدام إلزامية وضمان حقهم في التماس العفو أو تخفيف الحكم بالإعدام.

25. In January 2012, the parliament of the Islamic Republic of Iran (Majlis) decided that juveniles below 18 who commit offences under the categories of Hudud and Qisas (retribution in kind) will not receive mandatory death sentences if the court decides, through forensic reports or any other appropriate means, that the offender did not have adequate mental maturity and the ability to reason.
25 - وفي كانون الثاني/يناير 2012، قرر برلمان جمهورية إيران الإسلامية (المجلس) أن الأحداث الذين تقل أعمارهم عن 18 سنة ويرتكبون جرائم تندرج ضمن الفئات الموجبة لإقامة الحد والقصاص لن تصدر بحقهم أحكام إعدام إلزامية إذا قررت المحاكم، اعتمادا على تقارير للطب الشرعي أو أي وسائل أخرى مناسبة، أن الجاني لم يكن يتمتع بالنضج العقلي الكافي أو القدرة على عقل الأمور().

In its judgment, the High Court Division of the Supreme Court of Bangladesh stated that " any provision of law which provides a mandatory death penalty cannot be in accordance with the Constitution as it curtails the court's discretion to adjudicate on all issues brought before it, including imposition of an alternative sanction upon the accused found guilty of any offence under any law " .
وذكرت شعبة المحاكم العالية بالمحكمة العليا لبنغلاديش، في حكمها، أن " أي نص قانوني يقرر عقوبة إعدام إلزامية لا يمكن أن يتفق مع الدستور لأنه يقلص السلطة التقديرية للمحكمة في الفصل في جميع المسائل المعروضة عليها، بما في ذلك فرض عقوبة بديلة على المتهم الذي تثبت إدانته بارتكاب أي جريمة بموجب القانون " ().
