Consequently, it was difficult to see how the words of article 2 of the Covenant regarding a State party's undertaking to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized therein were only capable of interpretation as meaning that they applied solely to people who were both within the territory and subject to its jurisdiction.
وبناء على ذلك فإنه من الصعب تصور كيف إنه لا يمكن تفسير نص المادة 2 من العهد بشأن تعهد الدولة الطرف باحترام الحقوق المعترف بها فيه وبتأمينها لجميع الأفراد الموجودين في إقليمها والداخلين في ولايتها إلا بمعنى مفاده أنها تنطبق فحسب على الأفراد الموجودين في إقليمها والداخلين في ولايتها في آن واحد.

Article 2 of the Covenant expressly stated that each State party undertook to respect and ensure the rights recognized " to all individuals within its territory and subject to its jurisdiction " .

Mr. Eide agreed that Professor Thornberry had raised an important issue and reminded the Working Group that article 2 of the International Covenant on Civil and Political Rights referred to the undertaking of each State party " ... to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the present Covenant " .

For example, under article 2 of the International Covenant on Civil and Political Rights, each State party to the Covenant undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the Covenant, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.

55. Under the International Covenant on Civil and Political Rights, civil and political rights must first, as a rule, be recognized by a State to " all individuals within its territory and subject to its jurisdiction without distinction " (art. 2).
