Each State Party may likewise take such measures as may be necessary to establish its jurisdiction over the offences referred to in article 2 in cases where the alleged offender is present in its territory and it does not extradite that person to any of the States Parties which have established their jurisdiction in accordance with paragraph 1 or 2 of the present article.
٥ - كذلك تتخذ كل دولة طرف ما يلزم من تدابير لتقرير ولايتها القضائية على الجرائم المنصوص عليها في المادة ٢ في الحالات التي يكون فيها الشخص المدعى ارتكابه الجريمة موجــودا فــي إقليمها ولا تسلمه إلى أي من الدول اﻷطراف التي قررت ولايتها القضائية وفقا للفقرة ١ أو ٢ من هذه المادة.

3. Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over the offences set forth in article 2 in cases where the alleged offender is present in its territory and it does not extradite that person to any of the States Parties which have established their jurisdiction in accordance with paragraphs 1 or 2 of this article.

٤ - تتخذ كل دولة طرف ما يلزم من تدابير ﻹقامة ولايتها على الجرائم المبينة في المادة ٩ إذا كان المدعى ارتكابه الجريمة موجودا في إقليمها ولم تقم بتسليمه ، عملا بالمادة ١٥ ، إلى أي من الدول اﻷطراف التي أقامت ولايتها وفقا للفقرة ١ أو ٢.

Each State Party shall take such measures as may be necessary to establish its jurisdiction over the crimes set out in article 9 in cases where the alleged offender is present in its territory and it does not extradite such person pursuant to article 15 to any of the States Parties which have established their jurisdiction in accordance with paragraph 1 or 2.
٤ - تتخذ كل دولة طرف ما يلزم من تدابير ﻹقامة ولايتها على الجرائم المبينة في المادة ٩ إذا كان المدعى ارتكابه الجريمة موجودا في إقليمها ولم تقم بتسليمه عملا بالمادة ٥١ إلى أي من الدول اﻷطراف التي أقامت ولايتها وفقا للفقرة ١ أو ٢.

٤ - تتخذ كل دولة طرف بالمثل ما قد يلزم من تدابــير ﻹثبات ولايتها القضائيــة على الجرائم المشار إليها في المادة ١ مكرر في الحالات التي يكون فيها الجاني المزعوم متواجدا في أراضيها ولا تسلم هذا الشخص إلى أي من الدول اﻷطراف التي أثبتت ولايتها القضائية طبقا للفقرة ١ أو ٢.

4. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the crimes set out in article 10 in cases where the alleged offender is present in its territory and it does not extradite such person pursuant to article 16 to any of the States Parties referred to in paragraphs 1 and 2 above.
٤ - تتخذ كل دولة طرف ما يلزم من تدابير لتقرير ولايتها على الجرائم المبينة في المادة ٠١ إذا كان المدعى أنه الجاني موجودا في إقليمها ولم تقم بتسليمه عملا بالمادة ٦١ إلى أي من الدول اﻷطراف المشار إليها في الفقرتين ١ و ٢ أعلاه.
