The shipper, on delivery of the goods to the carrier or to the performing party for carriage, is entitled to obtain from the carrier, at the shipper's option:
يحق للشاحن عند تسليم البضاعة إلى الناقل أو إلى الطرف المنفّذ بغرض نقلها أن يحصل من الناقل وحسب اختيار الشاحن على:

(a) The shipper shall inform the carrier of the dangerous nature or character of the goods in a timely manner before they are delivered to the carrier or a performing party.
(أ) يبلّغ الشاحنُ الناقلَ بما للبضاعة من طبيعة أو خاصية خطرة في وقت مناسب قبل تسليمها إلى الناقل أو إلى طرف منفّذ.

(a) A reasonable external inspection of the goods as packaged at the time the shipper delivers them to the carrier or a performing party; and
(أ) تفقّد خارجي معقول للبضاعة وهي مرزومة، عندما يسلمها الشاحن إلى الناقل أو إلى الطرف المنفّذ؛

4. When the goods are delivered for carriage to the carrier or a performing party in a closed container, the carrier may qualify the information referred to in:
٤- عندما تُسلَّم البضاعة إلى الناقل أو الطرف المنفّذ في حاوية مغلقة بغرض نقلها، يجوز للناقل أن يتحفظ على المعلومات المشار إليها في:

(a) A reasonable external inspection of the goods as packaged at the time the shipper delivers them to the carrier or a performing party; and
(أ) تفقُّد خارجي معقول للبضاعة وهي مرزومة عندما يسلّمها الشاحن إلى الناقل أو إلى الطرف المنفّذ؛

(a) The shipper shall inform the carrier of the dangerous nature or character of the goods in a timely manner before they are delivered to the carrier or a performing party.
(أ) يبلّغ الشاحنُ الناقلَ بخطورة البضاعة في وقت مناسب قبل تسليمها إلى الناقل أو إلى طرف منفِّذ.

٤- عندما تُسلَّم البضاعة إلى الناقل أو الطرف المنفِّذ في حاوية أو عربة مغلقة بغرض نقلها، يجوز للناقل أن يتحفظ على المعلومات المشار إليها في:

There was support for the view that paragraph 1 was unnecessary since the issuance of the notice to the carrier or the performing party, or the failure to provide such a notice, did not affect the respective burdens of proof of the carrier and of the claimant as set out in the general liability regime in draft article 17.

It was thus suggested that the first sentence of paragraph 11.5 should be amended to refer to " the carrier or the performing party " .
واقتُرح، من ثم، تعديل الجملة الأولى من الفقرة 11-5 لكي تشير إلى " الناقل أو الطرف المنفّذ " .

Under subparagraph 8.2.2 (a), the carrier had no duty to inspect the goods beyond what would be revealed by a reasonable external inspection of the goods as packaged at the time the consignor delivered them to the carrier or a performing party.
فبموجب الفقرة الفرعية 8-2-2 (أ)، لا يقع على عاتق الناقل واجب أن يتفقد البضائع بما يتجاوز ما يكشفه التفقّد الخارجي المعقول للبضائع، وهي مغلّفة، عندما يسلمها المرسل إلى الناقل أو إلى الطرف المنفذ.

Failure to provide the notice referred to in this article to the carrier or the performing party shall not affect the right to claim compensation for loss of or damage to the goods under this Convention, nor shall it affect the allocation of the burden of proof set out in article 18.
2- لا يجوز أن يفضي عدم توجيه الإخطار المشار إليه في هذه المادة إلى الناقل أو الطرف المنفذ إلى المساس بالحق في المطالبة بالتعويض عن هلاك البضاعة أو تلفها بمقتضى هذه الاتفاقية، ولا إلى المساس بإلقاء عبء الإثبات المبيّن في المادة 18.
