7.1 The Committee must decide whether the forced return of the complainants to Sri Lanka would violate the State party's obligation, under article 3, paragraph 1, of the Convention, not to expel or return (refouler) individuals to another State where there are substantial grounds for believing that they would be in danger of being subjected to torture.
7-1 ويجب على اللجنة أن تقرر ما إذا كانت إعادة أصحاب الشكوى قسراً إلى سري لانكا تشكل انتهاكاً لالتزام الدولة الطرف، بموجب الفقرة 1 من المادة 3 من الاتفاقية، بعدم القيام بطرد أي أشخاص أو إعادتهم قسراً إلى دولة أخرى إذا توافرت لديها أسباب جوهرية تدعو إلى الاعتقاد بأنهم سيواجهون خطر التعرض للتعذيب.

7.2 The Committee must decide whether the deportation of the complainant to Colombia constituted a violation of the State party's obligation under article 3 of the Convention not to expel or return an individual to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.
7-2 ويجب على اللجنة أن تقرر ما إذا كان إبعاد صاحب الشكوى إلى كولومبيا قد شكل انتهاكاً من جانب الدولة الطرف لالتزاماتها بموجب المادة 3 من الاتفاقية، التي تنص على عدم طرد أو إعادة شخص إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه يواجه خطر التعرض للتعذيب.

4.6 It further notes that, under article 3 of the Convention, States parties are prohibited from expelling, returning or extraditing a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
4-6 وتلاحظ الدولة الطرف كذلك أن المادة 3 من الاتفاقية تنص على أنه لا يجوز للدول الأطراف أن تطرد أي شخص أو تُعيده أو تردّه إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيواجه خطر التعرّض للتعذيب.

وينبغي ألا تقوم الدولة الطرف، تحت أي ظرف من الظروف، بطرد أو إعادة أو تسليم أي شخص إلى دولة أخرى إذا وُجدت أسباب معقولة تدعو إلى الاعتقاد بأن هذا الشخص معرض لخطر التعذيب أو سوء المعاملة في بلد الاستقبال.

The Committee recommends that the State party strictly observe in all cases article 3 of the Convention requiring that the State party shall not expel, return or extradite a person to another State where there are substantial grounds for believing that the person would be in danger of being subjected to torture.
توصي اللجنة الدولة الطرف بأن تلتزم بدقة، وفي جميع الحالات، بالمادة 3 من الاتفاقية التي تقضي بأنه لا يجوز للدولة الطرف أن تطرد أي شخص أو أن تعيده أو أن تسلمه إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

6.2 The issue before the Committee is whether the return of the complainants to the Syrian Arab Republic would violate the obligation of the State party under article 3 of the Convention not to expel or return a person to a State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
