In this respect, the Committee refers to its jurisprudence that a State party cannot be held responsible for the conduct of a defence lawyer, unless it was or should have been manifest to the judge that the lawyer's behaviour was incompatible with the interests of justice.
وتشير اللجنة إلى قراراتها السابقة التي تفيد بأنه لا يمكن اعتبار الدولة الطرف مسؤولة عن سلوك المحامي، ما لم يتضح أو يرى القاضي أن سلوك المحامي يناقض العدالة(4).

" As to the author's claim under article 1 of the Covenant, the Committee refers to its jurisprudence that, for the purposes of a communication under the Optional Protocol, article 1 cannot on its own be the subject of a communication under the Optional Protocol.

8.3 In this regard, the Committee refers to its jurisprudence in Filipovich v. Lithuania, where it concluded there was no violation of article 15, paragraph 1, because the author's sentence was well within the margin provided by the earlier law and that the State party had referred to the existence of certain aggravating circumstances.
8-3 وفي هذا الصدد، تشير اللجنة إلى قراراتها السابقة بشأن قضية فيليبوفيش ضد ليتوانيا()، حيث خلصت إلى أنه لا يوجد انتهاك للفقرة 1 من المادة 15، لأن الحكم الصادر ضد صاحب البلاغ يدخل فعلاً في النطاق الذي حدّده القانون السابق ولأن الدولة الطرف قد أشارت إلى وجود بعض الظروف المشددة.

The Committee refers to its prior jurisprudence and reiterates that it is generally not for the Committee, but for the appellate Courts of States parties, to evaluate the facts and evidence in a specific case, unless it can be ascertained that the evaluation was clearly arbitrary or amounted to a denial of justice.
وتشير اللجنة إلى قراراتها السابقة وتكرر التأكيد أنه بوجه عام ليس من اختصاص اللجنة، بل من اختصاص محاكم الاستئناف في الدول اﻷطراف، تقييم الوقائع واﻷدلة في قضية معينة، ما لم يكن بالاستطاعة التأكد من أن التقييم كان تعسفيا بصورة واضحة أو أنه يرقى إلى إنكار العدالة.

7.2 The Committee refers to its prior jurisprudence and reiterates that although a State is not required under article 26 of the Covenant to adopt social security legislation, if it does, such legislation must comply with article 26 of the Covenant.
٧-٢ وتحيــل اللجنــة إلى قراراتها السابقة وتكـرر القــول بأنه، رغم كـون الدولة غير مطالَبة بموجب المادة ٦٢ من العهد باعتماد تشريع يتعلق بالضمان الاجتماعي، فإذا فعلت ذلك وجــب أن يراعي مثل هذا التشريع المادة ٦٢ من العهد.

The Committee referred to its prior jurisprudence, as well as to rule 90 (b) of its rules of procedure, in accepting the legitimacy of authorization in such circumstances.
وأشارت اللجنة إلى قراراتها السابقة()، وكذلك إلى المادة 90(ب) من نظامها الداخلي، مؤكدةً بذلك صحة التفويض في ظروف مثل تلك التي أحاطت بالقضية المعروضة عليها.
