82. The Iraqi Civil Code defines as a child every human being below the age of 18 years. The Juvenile Welfare Act No. 76 (1983) places children in the following categories, by age group:
82- يعني الطفل في مفهوم القانون المدني العراقي، كل إنسان لم يبلغ سن الثامنة عشرة من العمر، ويفصل قانون رعاية الأحداث المرقم 76 لسنة 1983 عمر الطفل وتسمياته على النحو الآتي:

The Committee reminds the State party that under the Convention on the Rights of the Child, a child is defined as every human being under the age of 18.
وتذكر اللجنة الدولة الطرف أن الطفل يُعرف بموجب اتفاقية حقوق الطفل على أنه كل إنسان لم يتجاوز الثامنة عشرة من العمر.

10- " الطفل " ، حسب التعريف الوارد في الاتفاقية، هو " كل إنسان لم يتجاوز الثامنة عشرة، ما لم يبلغ سن الرشد قبل ذلك بموجب القانون المنطبق عليه " ().

Article 1 of the Convention on the Rights of the Child defines a child as " every human being below the age of eighteen years unless under the law applicable to the child, majority is attained earlier, " and article 2 clarifies that Convention rights are to be enjoyed by children " without discrimination of any kind " , including on grounds of sex.
ويُعرَّف الطفل في المادة 1 من اتفاقية حقوق الطفل بأنه ' ' كل إنسان لم يتجاوز الثامنة عشرة، ما لم يبلغ سن الرشد قبل ذلك بموجب القانون المنطبق عليه``، كما توضح المادة 2 أن الأطفال يتمتعون بالحقوق الواردة في الاتفاقية ' ' دون تمييز من أي نوع``، بما في ذلك على أساس نوع الجنس.

9. A " child as defined in article 1 of the Convention " , means " every human being below the age of 18 years unless under the law applicable to the child, majority is attained earlier " .
9- تعني عبارة " الطفل حسب التعريف الوارد في المادة 1 من الاتفاقية " ، " كل إنسان لم يتجاوز الثامنة عشرة، ما لم يبلغ سن الرشد قبل ذلك بموجب القانون المنطبق عليه " .

32. A juvenile is defined, in the penal laws set forth in the Detention and Juvenile Homes Statues of 1975, as every human being below the age of 18 years.
32- وعُرِّف الحدث في القوانين الجزائية المبينة في لائحة الاستيقاف ولائحة دور الأحداث الصادرة في عام 1395ه(1975 م) بأنه كل إنسان لم يبلغ الثامنة عشرة من العمر.

7- " يعني الطفل كل إنسان لم يتجاوز الثامنة عشرة، ما لم يبلغ سن الرشد قبل ذلك بموجب القانون المنطبق عليه " ، وفقاً لتعريف المادة 1 من اتفاقية حقوق الطفل.

وينص الميثاق على أن الطفل يعني أي إنسان لم يبلغ سن 18 سنة كما ينص على أن تتخذ الدول الأطراف كافة التدابير اللازمة لضمان عدم مشاركة أي طفل في العمليات الحربية بصورة مباشرة وتمتنع بوجه خاص عن تجنيد أي طفل.

كما عرف قانون الحضانة العائلية الحدث بأنه كل إنسان لم يتجاوز ٨١ عاما ولم يبلغ سن الرشد.

وينص هذا القانون على تعريف واضح لمفهوم الطفل يمكن للجميع فهمه إذ يعتبر الطفل " كل إنسان لم يتجاوز الثامنة عشرة من العمر " .

Provisions prescribing penalties for offences committed against a person under 18 years of age have also been added to the relevant articles. These offences include: incitement of minors to theft; violation of personal liberty; use of force; deprivation of liberty; slavery; abduction and associated offences; threat; rape; indecent assault with coercion; incitement to prostitution and depravity; forcing a confession; and organ trafficking.
كما تم إضافة فقرات إلى بعض المواد تبين عقوبة الجرائم المذكورة فيها إذا هي وقعت على إنسان لم يتم الثامنة عشرة من عمره ومن هذه الجرائم: تحريض الصغار على السرقة، التعرض لحرية الأشخاص، استعمال القسوة، الحجز على الحرية، جريمة الرق، الخطف والجرائم المقترنة به، التهديد، الاغتصاب، عقوبة هتك العرض بالإكراه، التحريض على الفجور والدعارة، الإكراه على الاعتراف.
