It must also implement the advisory opinion dated 16 October 1975 in which the International Court of Justice concluded that no tie of territorial sovereignty could be established between the territory of Western Sahara and the Kingdom of Morocco or the Mauritanian entity and that the decolonization of Western Sahara should continue in accordance with General Assembly resolution 1514 (XV).

In the aftermath of the military invasion and occupation of Western Sahara by the Moroccan army in October 1975, made possible by the renunciation on the part of the former colonial Power, Spain, of its responsibilities under the Charter of the United Nations, the international community has constantly been active in its efforts aimed at bringing about the decolonization of Western Sahara, the last colonial case in Africa.

38. The representative of the Frente Popular para la Liberación de Saguía el-Hamra y de Río de Oro (Frente POLISARIO) stated that the Special Committee had had the question of Western Sahara on its agenda since the 1970s as a decolonization issue and that it would remain the primary body responsible for the decolonization of Western Sahara until the Sahrawi people exercised their legitimate right to self-determination and independence.
38 - وذكر ممثل الجبهة الشعبية لتحرير الساقية الحمراء ووادي الذهب (البوليساريو) أن مسألة الصحراء الغربية مدرجة على جدول أعمال اللجنة الخاصة منذ السبعينات بوصفها مسألة من مسائل إنهاء الاستعمار وستظل اللجنة هى الجهاز الرئيسي المسؤول عن إنهاء استعمار الصحراء الغربية ريثما يحصل الشعب الصحراوي على حقه المشروع في الحكم الذاتي.

Mr. Boukhari (Frente Popular para la Liberación de Saguia el-Hamra y de Río de Oro (Frente POLISARIO)) said that the discussion of the question of Western Sahara was very timely in the light of the adoption by the Security Council of resolution 1485 (2003) on 30 May 2003, in which it had decided to postpone until July 2003 its consideration of the decolonization of Western Sahara.
