In view of the fact that the assignment is effective as of the time of the conclusion of the contract of assignment, the debtor, having knowledge of the assignment, may choose to discharge its debt by paying the assignee even before notification.
وبما أن الاحالة تصبح نافذة المفعول اعتبارا من تاريخ ابرام عقد الاحالة، فإنه يمكن أن يختار المدين، بعد معرفته بالاحالة، ابراء ذمته من الدين بالسداد الى المحال اليه.

In order to avoid covering a receivable which at the time it arose was international but at the time of the conclusion of the contract of assignment had become domestic, the suggestion was made that the internationality of a receivable should be determined at the time of the conclusion of the contract of assignment and not at the time the receivable arose.

It was observed that, in view of the risk that, after the conclusion of the contract of assignment, the assignor might assign the same receivables to another assignee or become insolvent, it was essential to set the time of the transfer of the assigned receivables at the time of the conclusion of the contract of assignment.
ولوحظ أنه ، بالنظر الى احتمال أن يقوم المحيل ، بعد ابرام عقد الاحالة ، باحالة نفس المستحقات الى محال اليه آخر أو أن يصبح المحيل معسرا ، فمن الضروري تحديد وقت نقل المستحقات المحالة بوقت ابرام عقد الاحالة .

(a) This Convention does not apply to such types of assignment or to the assignment of such categories of receivables if the assignor is located at the time of the conclusion of the contract of assignment in such a State; and
(أ) لا تنطبق هذه الاتفاقية على أنواع الاحالة تلك أو على احالة فئات المستحقات تلك اذا كان مقر المحيل واقعا في تلك الدولة وقت ابرام عقد الاحالة؛

The term " time of assignment " is used only in draft article 9, paragraph 1 (b), but reference could be made there, as in other provisions (e.g. articles 1, paragraph 1 (a), 3, 4, subparagraph (b), 14, 38, 41 and 6 of the annex), directly to the time of the conclusion of the contract of assignment.
