3.1 The author claims that by detaining her nephew for six days without informing him of the charges against him, the State party violated his rights under article 9, paragraph 2.
3-1 تدعي صاحبة البلاغ أن الدولة الطرف، باحتجازها ابن أختها لمدة ستة أيام دون إخباره بالتهم الموجهة إليه، تكون قد انتهكت حقوقه بموجب الفقرة 2 من المادة 9.

She adds that her nephew was only brought before a judge after six days' detention, which is said to amount to violation by the State party of his rights under article 9, paragraph 3, of the Covenant.

2.5 The author claims that her nephew had no opportunity to submit an appeal himself against the violations of his rights under the Covenant due to the compulsory requirement in Poland for appeals to be submitted by lawyers.
2-5 وتدعي صاحبة البلاغ أن ابن أختها لم يجد فرصة لتقديم طعن بنفسه في انتهاك حقوقه بموجب العهد نظراً للشرط الإلزامي في بولندا الذي يقضي بأن تُقدم الطعون من قبل محامين.

6.4 As regards the author's claims relating to article 14, paragraph 1, of the Covenant, the Committee observed that the author had not provided any explanation on how her nephew's right under this provision were violated.
6-4 وفيما يخص ادعاء صاحبة البلاغ المتعلق بالفقرة 1 من المادة 14 من العهد، لاحظت اللجنة أن صاحبة البلاغ لم تقدم أي تفسير عن الطريقة التي انتُهك بها حق ابن أختها بموجب هذا الحكم.

6.5 The Committee further noted the author's claim that her nephew's right under article 26 were violated as he had been allegedly discriminated by the Polish authorities on the basis of his nationality.
6-5 ولاحظت اللجنة علاوة على ذلك ادعاء صاحبة البلاغ بأن حقوق ابن أختها بموجب المادة 26 انتُهكت لأنه تعرض فيما يبدو للتمييز من جانب السلطات البولندية على أساس جنسيته.

8.3 The author claims that the State party has not submitted any concrete evidence that Mr. Rastorguev was provided with free legal assistance before the court of two instances and maintains that no adequate legal aid was provided to her nephew.
8-3 وتدعي صاحبة البلاغ أن الدولة الطرف لم تقدم أي دليل ملموس على أن السيد راستورغيف تلقى مساعدة قانونية مجانية أمام محكمتي الدرجتين الأولى والثانية، وتؤكد أن ابن أختها لم يتلق مساعدة قانونية كافية.

The author claims that the State party has not provided sufficient explanations to justify the delay of six days before bringing her nephew before a judge and considers that this delay is too long and does not meet the requirement of promptness in the sense of art. 9, paragraph 3, of the Covenant.
