(iii) any mission of enquiry established pursuant to the provisions of the Geneva Conventions of 12 August 1949 and, where applicable, their Additional Protocols.

13. The texts of the so—called “Martens clause” and article 3 common to the Geneva Conventions of 12 August 1949, both of which were repeatedly referred to during the Workshop, are reproduced in appendix 2.

Mindful that Myanmar is a party to the Convention on the Rights of the Child and the Geneva Conventions of 12 August 1949 on the protection of war victims,
وإذ تضع في اعتبارها أن ميانمار طرف في اتفاقية حقوق الطفل، وفي اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ بشأن حماية ضحايا الحرب،

The following fundamental guarantees contained in common article 3 to the Geneva Conventions of 12 August 1949 are also applicable in all situations pertaining to Sri Lanka:
٥٦- والضمانات اﻷساسية التالية الواردة في المادة ٣ المشتركة فيما بين اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ تنطبق أيضاً في جميع الحالات المتصلة بسري لانكا:

Noting the commitments entered into by States in fields pertaining to humanitarian law, and particularly the Geneva Conventions of 12 August 1949 and their Additional Protocols of 1977,
وإذ تشير إلى الالتزامات التي تعهدت بها الدول في المجالات المتصلة بالقانون اﻹنساني، وبصفة خاصة إلى اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ والبروتوكولين الاضافيين الملحقين بها لعام ١٩٧٧،

18. Invites the Government of Myanmar to respect fully its obligations under the Geneva Conventions of 12 August 1949, and to avail itself of such services as may be offered by impartial humanitarian bodies;
٨١- تدعو حكومة ميانمار الى أن تحترم بالكامل التزاماتها بموجب اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١، وأن تستفيد مما قد تمنحه الهيئات الانسانية النزيهة من خدمات؛

The Government of Japan argues that the Geneva Conventions of 12 August 1949 and other instruments of international law did not exist during the period of the Second World War and, therefore, the Government is not responsible for violating international humanitarian law.
٦٩ - وتحتج حكومة اليابان بأن اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ وغيرها من صكوك القانون الدولي لم تكن موجودة خلال فترة الحرب العالمية الثانية وبالتالي فإن الحكومة لا تتحمل المسؤولية عن انتهاك القانون الانساني الدولي.

Recalling that, in accordance with common article 1 of the Geneva Conventions of 12 August 1949, all States parties to the Conventions have undertaken to respect and ensure respect for the Conventions in all circumstances,

This term, as used in these principles, covers war crimes, crimes against humanity and grave breaches within the meaning of the Geneva Conventions of 12 August 1949 and Additional Protocols I and II of 8 June 1977.
المقصود بهذا الوصف، في إطار هذه المبادئ، هو جرائم الحرب والجرائم ضد اﻹنسانية والانتهاكات الخطيرة بموجب أحكام اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ والبروتوكولين اﻹضافيين اﻷول والثاني الملحقين بها بتاريخ ٨ حزيران/يونيه ٧٧٩١.

" 2. This Protocol shall apply, in addition to situations referred to in Article I of this Convention, to situations referred to in Article 3 common to the Geneva Conventions of 12 August 1949.
" 2- ينطبق هذا البروتوكول، بالإضافة إلى الحالات المشار إليها في المادة 1 من هذه الاتفاقية على الحالات المشار إليها في المادة 3 المشتركة بين اتفاقيات جنيف المؤرخة في 12 آب/أغسطس 1949.

48. Calls upon all States and other parties to armed conflict to respect fully international humanitarian law and, in this regard, calls upon States parties to respect fully the provisions of the Geneva Conventions of 12 August 1949, and the Additional Protocols thereto of 8 June 1977;
48- يهيب بجميع الدول والأطراف الأخرى في النزاع المسلح أن تحترم القانون الإنساني الدولي احتراماً كاملاً، ويهيب في هذا الشأن بالدول الأطراف أن تحترم بالكامل أحكام اتفاقيات جنيف المؤرخة في 12 آب/أغسطس 1949، والبروتوكولين الإضافيين الملحقين بها المؤرخين في 8 حزيران/يونيه 1977؛

Mindful that Iraq is a party to the International Covenants on Human Rights and to other international human rights instruments, and to the Geneva Conventions of 12 August 1949 on the protection of war victims,
وإذ تضع في اعتبارها أن العراق طرف في العهدين الدوليين الخاصين بحقوق اﻹنسان وفي غيرهما من الصكوك الدولية المتعلقة بحقوق اﻹنسان، وفي اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ والمتعلقة بحماية ضحايا الحرب،

6. Also calls upon all States to consider enacting legislation as required by the Geneva Conventions of 12 August 1949 to provide jurisdiction in their municipal courts for serious international crimes committed in other States, thereby increasing the potential venues in which acts of sexual violence may be prosecuted;
٦- تطلب أيضاً إلى جميع الدول النظر في إمكانية سن تشريعات حسب ما تقتضيه اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ بغية إتاحة الاختصاص القضائي لمحاكمها الوطنية لتحاكم على الجرائم الدولية الخطيرة المرتكبة في دول أخرى، مما يزيد من توفر اﻷماكن المحتملة التي يمكن فيها المحاكمة على أفعال العنف الجنسي؛

Guided by the Charter of the United Nations, the Universal Declaration of Human Rights, the International Covenants on Human Rights and international humanitarian law, as set out in the Geneva Conventions of 12 August 1949 and the Additional Protocols thereto of 1977,
إذ تسترشد بميثاق اﻷمم المتحدة واﻹعلان العالمي لحقوق اﻹنسان والعهدين الدوليين الخاصين بحقوق اﻹنسان والقانون اﻹنساني الدولي، كما هو مبين في اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ وبروتوكولي ٧٧٩١ اﻹضافيين الملحقين بها،

Mindful of the principles and humanitarian provisions of the Geneva Conventions of 12 August 1949 for the protection of war victims, of the principles and provisions of international law, and of the obligations arising from the Regulations concerning the Laws and Customs of War on Land, annexed to the Hague Convention IV of 1907,
وإذ تضع في اعتبارها المبادئ واﻷحكام الانسانية المنصوص عليها في اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ فيما يتعلق بحماية ضحايا الحرب، ومبادئ وأحكام القانون الدولي، والالتزامات الناشئة عن اﻷنظمة المتعلقة بقوانين وأعراف الحرب البرية، المرفقة باتفاقية لاهاي الرابعة لعام ٧٠٩١،

25. Demands the immediate internationally supervised release of all persons arbitrarily or otherwise illegally detained and the immediate closure of all places of detention not authorized by or in compliance with the Geneva Conventions of 12 August 1949 and the Additional Protocols thereto;
٥٢- تطالب بالافراج فورا تحت إشراف دولي عن جميع اﻷشخاص المعتقلين بطريقة تعسفية أو بطرق أخرى غير مشروعة، وبالاغلاق الفوري لكل أماكن الاعتقال التي لا تأذن بها اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ أو التي لا تمتثل لهذه الاتفاقيات؛

Affirming the need to respect the principles of the Charter of the United Nations, the Universal Declaration of Human Rights, the International Covenants on Human Rights and the relevant provisions of the Geneva Conventions of 12 August 1949 and the two Additional Protocols thereto,
إذ تؤكد الحاجة إلى احترام مبادئ ميثاق اﻷمم المتحدة، واﻹعلان العالمي لحقوق اﻹنسان، والعهدين الدوليين الخاصين بحقوق اﻹنسان، واﻷحكام ذات الصلة من اتفاقيات جنيف المؤرخة في ٢١ آب/أغسطس ٩٤٩١ والبروتوكولين اﻹضافيين الملحقين بها،

Finally, and in analysing the information he has received, the Special Rapporteur observes that article 3 (1) common to the four Geneva Conventions of 12 August 1949 provide as follows:
