His delegation supported the approach adopted by the Vienna Conventions on the Law of treaties concerning reservations which affirmed, on the one hand, the sovereign right of States to formulate reservations and, on the other, the principle that reservations to a treaty must not be incompatible with its object and purpose.

His delegation was in agreement with the conclusions of the Special Rapporteur and the Commission to the effect that the achievements of the Commission with respect to reservations should not be called into question, since the rules set forth in the Vienna Conventions on the Law of Treaties operated relatively well, irrespective of their possible ambiguities.

69. On the subject of reservations to treaties, his delegation favoured the Commission’s approach in preparing a Guide to practice, taking as a basis the general regime for reservations contained in the Vienna Conventions on the Law of Treaties, rather than developing a more formal instrument.

1. Mr. Montesino (Spain), referring to the topic of reservations to treaties, said that the very comprehensive and accurate work carried out should help States to resolve practical issues that had not been sufficiently covered by the Vienna Conventions on the Law of Treaties.

Nonetheless, misunderstandings sometimes arose in connection with this second aspect of the Special Rapporteur's method, which was to reproduce word for word the provisions of the Vienna Conventions on the Law of Treaties relating to reservations: certain members of the Commission strongly supported proposals to insert amendments in the draft guidelines of the Guide to Practice which, in their view, would improve them.

However, leaving the question unanswered presents few drawbacks: it is true that the first subparagraph of article 19 of the Vienna Conventions on the Law of treaties sets out the principle of the right to formulate reservations; however, like all rules governing reservations (and like the vast majority of other rules) set out in these Conventions, this is an optional residual rule which negotiators can reject if they find it useful to do so.
