• the Arrest Convention

The provisions of the Arrest Convention cover practically all maritime liens recognized by the 1993 International Convention on Maritime Liens and Mortgages.
وتشمل أحكام اتفاقية الحجز تقريبا كل أنواع الحجز البحري التي تقرها الاتفاقية الدولية المعنية بالحجوز والرهون لعام ١٩٩٣.

The inclusion of this proposal in the Arrest Convention was regarded as preventing the remedy of arrest being used to blackmail shipowners into payment of claims.
وبيﱠن الوفد أن إدراج هذا المقترح في اتفاقية الحجز يقدم حائلاً دون استخدام الحجز وسيلة لابتزاز الجهات المالكة للسفن ﻹرغامها على دفع تعويضات.

The JIGE agreed that it might be necessary to amend the Arrest Convention in the light of the decisions taken in respect of the draft maritime liens and mortgages convention.

179. the Arrest Convention stipulates that a ship may be arrested only in respect of a maritime claim and not in respect of any other claim and only under the authority of a Court.
٩٧١ - وتنص اتفاقية الحجز على أنه لا يجوز حجز سفينة إلا فيما يتعلق بمطالبة بحرية وليس فيما يتعلق بأي مطالبة أخرى وبموجب سلطة محكمة فقط.

180. the Arrest Convention is deposited with the Secretary- General of the United Nations and will be open for signature at United Nations Headquarters, New York, from 1 September 1999 to and including 31 August 2000.
١٨٠ - وقد تم إيداع اتفاقية الحجز لدى اﻷمين العام لﻷمم المتحدة، وسيفتح باب التوقيع عليها في مقر اﻷمم المتحدة، نيويورك، اعتبارا من ١ أيلول/سبتمبر ١٩٩٣ إلى غاية ٣١ آب/أغسطس ٢٠٠٠.

Article 1(1)(a) of the Arrest Convention has been reproduced in the CMI Draft.
وقد استنسخت المادة ١ )١( )أ( من اتفاقية الحجز في مشروع اللجنة البحرية الدولية.

It may be desirable to make a similar amendment in the Arrest Convention.
وقد يكون من المستصوب إدخال تعديل مماثل في اتفاقية الحجز)١١(.

17. Consideration may be given to amending the wording of Article 1(1)(m) of the Arrest Convention to bring it into line with that of the 1993 MLM Convention.
٧١- ويمكن إيلاء اعتبار لتعديل صياغة المادة ١ )١( )م( من اتفاقية الحجز لكي تتسق مع المادة المناظرة في اتفاقية الامتيازات والرهون البحرية لعام ١٩٩٣.

This delegation proposed inclusion in the Arrest Convention of a provision for the interlocutory sale of an arrested vessel in appropriate circumstances, such as failure of the owner to post security within a reasonable period of time, or where the costs of maintaining the vessel under arrest were excessive, etc.
واقترح هذا الوفد أن يدرج في اتفاقية الحجز حكم بشأن البيع الابتدائي لسفينة محجوزة وذلك في ظروف مناسبة مثل عدم ايداع المالك الضمانة خلال فترة زمنية معقولة او حيثما تكون تكاليف صيانة السفينة المحجوزة باهظة، وما الى ذلك.

This proposal was opposed by some delegations which felt that the issue was outside the scope of the Arrest Convention, since the term " arrest " , being confined to " conservatory " measures, did not include measures for satisfaction of judgement.
وقد اعترض على هذا الاقتراح عدة وفود اعتبرت أن المسألة خارجة عن نطاق اتفاقية الحجز ﻷن مصطلح " الحجز " باعتباره يقتصر على التدابير " التحفظية " لا يشمل تدابير استيفاء الحكم.

13. The representative of the International Chamber of Commerce stated that review of the Arrest Convention should go beyond the CMI Draft and take account of the changes brought about by the 1993 Convention on Maritime Liens and Mortgages.
٣١- وذكر ممثل الغرفة التجارية الدولية أن استعراض اتفاقية الحجز ينبغي أن يتجاوز مشروع اللجنة البحرية الدولية وأن يأخذ في الاعتبار التغييرات التي أحدثتها اتفاقية الامتيازات والرهون البحرية لعام ٣٩٩١.

In concluding, the Chairman of the Informal Group expressed the view that the question of aligning the Arrest Convention with article 6 of the MLM Convention in a satisfactory manner was crucial for the future of both the MLM Convention and the Arrest Convention.
واختتم رئيس الفريق غير الرسمي بالاعراب عن الرأي أن مسألة تنسيق اتفاقية الحجز مع المادة ٦ من اتفاقية الامتيازات والرهون البحرية بطريقة مرضية مسألة حاسمة بالنسبة لمستقبل كل من اتفاقية الامتيازات والرهون البحرية واتفاقية الحجز.
