As a general rule, only prequalified project consortia should be allowed to participate in the selection phase, unless the awarding authority can satisfy itself that a new consortium member meets the prequalification criteria to substantially the same extent as the retiring member of the consortium.
وكقاعدة عامة ، لا ينبغي السماح بالمشاركة في مرحلة الاختيار الا لاتحادات المشروع المثبتة أهليتها مسبقا ، ما لم تقتنع السلطة مانحة الامتياز بأن عضوا جديدا انضم الى الاتحاد يستوفي معايير اثبات اﻷهلية المسبق بمقدار ما كان يستوفيها العضو المنسحب من الاتحاد .

٧٤ - عقب الاثبات المسبق ﻷهلية اتحادات المشروع ، من المستصوب أن تقوم السلطة مانحة الامتياز باعادة النظر في دراستها اﻷصلية لجدوى المشروع وفي تحديدها لاشتراطات النواتج واﻷداء ، والبت فيما اذا كان ثمة حاجة الى تنقيح تلك الاشتراطات على ضوء المعلومات المحصلة أثناء اجراءات اثبات اﻷهلية المسبق .

Selection proceedings for the award of privately financed infrastructure projects typically require the preparation of extensive documentation by the awarding authority, including project outline, prequalification documents, the request for proposals, instructions for preparing proposals and a draft of the project agreement.
٠٣ - عادة ما تتطلب اجراءات الاختيار الرامية الى ارساء مشاريع البنى التحتية الممولة من القطاع الخاص قيام السلطة مانحة الامتياز باعداد وثائق مستفيضة ، بما في ذلك المخطط اﻷولي للمشروع ، ووثائق اثبات اﻷهلية المسبق ، وطلب تقديم المقترحات ، والتعليمات بشأن اعداد المقترحات ، ومسودة اتفاق المشروع .

5. prequalification proceedings The awarding authority should respond to any request by a project consortium for clarification of the prequalification documents that is received by the awarding authority within a reasonable time prior to the deadline for the submission of applications to prequalify.
٣٤ - ينبغي للسلطة مانحة الامتياز أن تستجيب ﻷي طلب يقدمه اتحاد المشروع لتوضيح وثائق اثبات اﻷهلية المسبق وتتلقاه السلطة مانحة الامتياز في غضون فترة معقولة من الزمن وقبل الموعد النهائي لتقديم الطلبات لاثبات اﻷهلية المسبق .

An awarding authority should not impose any criterion, requirement or procedure with respect to the qualifications of project consortia which has not been set forth in the prequalification documents (cf. UNCITRAL Model Law, article 6(3)).
ولا ينبغي للسلطة مانحة الامتياز أن تفرض أي معيار أو اشتراط أو اجراء بخصوص مؤهلات اتحاد المشروع مما لم يكن مبينا في وثائق اثبات اﻷهلية المسبق )انظر المادة ٦ )٣( من قانون اﻷونسيترال النموذجي( .

The response to any request that might reasonably be expected to be of interest to other project consortia should, without identifying the source of the request, be communicated to all project consortia to which the awarding authority provided the prequalification documents (cf. UNCITRAL Model Law, article 7(4)).
كما ان الاستجابة ﻷي طلب قد يتوقع بدرجة معقولة أن يهم اتحادات أخرى مشاركة في المشروع ، ينبغي أن يبلغ ، دون تحديد مصدر الطلب ، الى جميع اتحادات المشروع التي زودتها السلطة مانحة الامتياز بوثائق اثبات اﻷهلية المسبق )انظر المادة ٧ )٤( من قانون اﻷونسيترال النموذجي( .

Therefore, some countries authorize the awarding authority to consider arrangements for compensating prequalified proponents if the project cannot proceed for reasons outside their control or for contributing to the costs incurred by them after the prequalification phase, when justified in a particular case by the complexity involved and the prospect of significantly improving the quality of the competition.
٢٤ - ولذلك تأذن بعض البلدان للسلطة مانحة الامتياز بالنظر في اتخاذ ترتيبات لتعويض من تثبت أهليته مسبقا من مقدمي المقترحات ، اذا تعذر المضي في المشروع ﻷسباب خارجة عن ارادتهم ، أو للاسهام في التكاليف التي تكبدوها بعد مرحلة اثبات اﻷهلية المسبق ، عندما يسوغ ذلك في حالة معينة تعقد الظروف أو آفاق تحقيق تحسن هام في نوعية المنافسة .
