وفيما يتعلق بمسألة ما إن كانت المادة ٥٢ من العهد ذاتية التنفيذ، أعرب اثنان من القضاة عن رأي مفاده أنه ما من حاجة إلى النطق بحكم في هذه القضية على أساس عدم انطباق المادة ٩٦١-٣ من دستور قبرص.

The revised article 14, Officers and members of the Chambers, includes provisions to the effect that two of the judges to be elected or appointed in accordance with article 12 of the Statute of ICTR will be members of the Appeals Chamber.
أما المادة 14 المنقحة والمعنونة " أعضاء المكتب وأعضاء الدوائر " فتتضمن أحكاما تنص على أن يكون اثنان من القضاة المنتخبين أو المعينين وفقا للمادة 12 من النظام الأساسي للمحكمة الجنائية الدولية لرواندا عضوين في دائرة الاستئناف.

أما المادة 14 المنقحة وعنوانها " أعضاء المكتب وأعضاء الدوائر " فتتضمن أحكاما تنص على أن يكون اثنان من القضاة المنتخبين أو المعينين وفقا للمادة 12 من النظام الأساسي للمحكمة الجنائية الدولية لرواندا عضوين في دائرة الاستئناف.

Article 11, paragraph 1, of the Statute of the Tribunal provides that no two judges may be nationals of the same State.
وتنص الفقرة 1 من المادة 11 من النظام الأساسي للمحكمة على أنه لا يجوز أن يكون اثنان من القضاة من رعايا نفس الدولة.

There is also a proviso that no two judges shall be nationals of the same State.
وثمة نص أيضا بألا يكون اثنان من القضاة من رعايا دولة واحدة.

وكتدبير انتقالي، يعمل لمدة ثلاث سنوات اثنان من القضاة المعينين من البداية (قاضٍ متفرغ وقاض لنصف الوقت) يحددان عن طريق القرعة، ويجوز إعادة تعيينهما في محكمة المنازعات ذاتها لفترة إضافية مدتها سبع سنوات غير قابلة للتجديد.

Finally, since the beginning of 2009, two of the judges and members of the legal support staff have been engaged in another case (Presiding Judge Orie and Judge Gwaunza on Stanišić and Simatović), which has allowed both trials to move forward, but which has also resulted in resources being diverted from the Gotovina et al. trial.
وأخيرا، فقد أخذ اثنان من القضاة وأفراد من موظفي الدعم القانوني يشتغلون منذ بداية عام 2009 في قضية أخرى (القاضي أوري الذي يرأس المحاكمة والقاضي غووانزا، بشأن ستانيزيتش وسيماتوفيتش)، مما أتاح المضي قدماً في كلتا المحاكمتين، لكن ذلك أسفر أيضا عن تحويل موارد من محاكمة غوتوفينا وآخرين.
