Where preselection proceedings have been used, the criteria shall be the same as those used in the preselection proceedings.
وفي حال أن تم استخدام اجراءات الاختيار اﻷولي، فيجب أن تكون المعايير هي المعايير نفسها المستخدمة في اجراءات الاختيار اﻷولي.

Thus, they do not show the same level of automaticity that characterizes the preselection proceedings usually applied for the procurement of goods or services.
ومن ثم فهي لا تكون بنفس مستوى التلقائية التي تكون عليها اجراءات الاختيار اﻷولي التي تطبق عادة في حالة اشتراء السلع أو الخدمات .

" 3. To the extent not already required by [the enacting State indicates the provisions of its laws on procurement proceedings that govern the content of invitations to participate in proceedings for the pre-qualification of suppliers and contractors],8 the invitation to participate in the pre-selection proceedings shall include at least the following:

1. Invitation to the preselection proceedings
١ - الدعوة الى اجراءات الاختيار اﻷولي

The laws of many countries identify publications, usually the official gazette or other official publication, in which the invitation to the preselection proceedings is to be published.
وتحدد قوانين بلدان كثيرة المنشورات التي ينبغي أن تنشر فيها الدعوة الى اجراءات الاختيار اﻷولي ، وهي في العادة الجريدة الرسمية أو غيرها من المنشورات الرسمية .

For purposes of transparency, it is desirable for the law to provide that, where the contracting authority reserves the right to reject a proposal on those or similar grounds, adequate notice of that circumstance must be included in the invitation to the preselection proceedings.
وﻷغراض الشفافية ، من المستحسن أن ينص القانون على أنه في حال احتفاظ الهيئة المتعاقدة بالحق في رفض اقتراح ما بناء على تلك اﻷسباب أو أسباب مماثلة ، يجب أن تتضمن الدعوة الى اجراءات الاختيار اﻷولي اشعارا ملائما بذلك .

It is therefore advisable to provide in the invitation to the preselection proceedings that no company may participate, either directly or through subsidiary companies, in more than one consortium in the same selection proceedings.
ومن المستصوب بناء على ذلك النص في الدعوة الى اجراءات الاختيار اﻷولي على أنه لا يجوز ﻷي شركة أن تشارك ، سواء مباشرة أو من خلال شركات فرعية ، في أكثر من كونسورتيوم واحد في نفس اجراءات الاختيار .

وحيث يتوخى منح اﻷفضلية للهيئات المحلية ، يكون من المستصوب الاعلان عن ذلك مقدما ، ويفضل أن يكون الاعلان عنه في الدعوة الى اجراءات الاختيار اﻷولي .
