The Committee recommends that the State party should remain committed to prosecuting and trying alleged perpetrators of acts of torture who are present in any territory under its jurisdiction, regardless of their nationality.

(7) The Committee is concerned by the delegation's statement that while the provisions of the Convention are incorporated into the national legal system as enforceable rights, in practice, law enforcement officers, who have committed acts of torture, are not charged with the offence of torture, but rather with other offences such as murder, assault and rape (art. 4).

1. Establish a national mechanism to prevent torture, prohibit torture under domestic law, ensure observance of the provisions contained in the Criminal Code, carry out investigations into all allegations of torture or death during detention and prosecute the perpetrators of acts of torture
