It confined itself to using the actual text of the Vienna definition, according to which, when it formulates a reservation, a State or international organization “purports to exclude or to modify the legal effect of certain provisions of the treaty in their application to that State or to that organization”, specifying, however, that the same may also apply if the reservation relates to certain aspects of the treaty as a whole.

14- وتعرِف المادة 2 من اتفاقية فيينا لقانون المعاهدات " التحفظ " بأنه " إعلان من جانب واحد " ، أيا كانت صيغته أو تسميته، تصدره دولة ما حين توقع معاهدة أو تصدقها أو تقبلها أو تقرها أو تنضم إليها، مستهدفة به استبعاد أو تغيير الأثر القانوني لبعض أحكام المعاهدة في تطبيقها على تلك الدولة " .

This definition does not limit reservations to statements purporting to exclude or modify the actual terms of the treaty; it also covers statements purporting to exclude or modify the legal effect of certain provisions in their application to the reserving State.
ولا يحصر هذا التعريف نطاق التحفظات في الإعلانات التي تهدف إلى استبعاد أو تعديل أحكام المعاهدة بحد ذاتها؛ فهو يشمل أيضاً الإعلانات التي تهدف إلى استبعاد أو تغيير الأثر القانوني لبعض الأحكام في تطبيقها على الدولة المتحفظة.

Such statements did not purport to exclude or modify the legal effect of particular provisions of the treaty but sought rather to deny the entity in question the capacity to make a commitment, and therefore to preclude any treaty relationship with it.

Article 2, paragraph 1 (d), of the Vienna Convention on the Law of Treaties of 23 May 1969 states that a reservation " purports to exclude or to modify the legal effect of certain provisions of the treaty in their application to that State " , without providing further details on the modification effected by the reservation.

Article 2, paragraph 1 (d) of the Vienna Conventions defines a reservation as any unilateral statement whereby a State " purports to exclude or to modify the legal effect of certain provisions of the treaty " .

As the Vienna Convention makes clear, a declaration or statement is capable of constituting a reservation if " it purports to exclude or modify the legal effect of certain provisions of the treaty in their application to [the State concerned] " (emphasis added).
