After discussion, it was generally agreed that the Working Group should focus on enabling the use of electronic transferable records as equivalents of existing paper-based transferable documents.
29- وبعد المناقشة، اتُّفق عموماً على أن يركِّز الفريق العامل على إتاحة إمكانية استخدام السجلات الإلكترونية القابلة للتحويل كمعادِل للمستندات الورقية القابلة للتحويل.

Moreover, it was recalled that the use of electronic transferable records in cross-border trade would greatly benefit from the adoption of uniform standards for functional equivalence in the various jurisdictions and from the uniform interpretation of those standards.
13- وعلاوة على ذلك، استُذكر أنَّ استخدام السجلات الإلكترونية القابلة للتحويل في التجارة عبر الحدود سوف ينتفع كثيرا باعتماد معايير موحدة بشأن التعادل الوظيفي في مختلف الولايات القضائية. ومن تفسير تلك المعايير تفسيرا موحدا.

42. It was stated that the presence of a general reliability standard could hamper the use of electronic transferable records as legal consequences of failure to meet those standards were not clear.

It was indicated that the paper-based provisions of those Conventions were not compatible with the use of electronic transferable records and therefore bills of exchange, promissory notes and checks should be excluded from the scope of the draft provisions.

It was said that the use of electronic transferable records required the inclusion of information, such as a unique identifier, that might not be found on paper-based equivalents.
70- قيل إنَّ استخدام السجلات الإلكترونية القابلة للتحويل يتطلَّب إدراج معلومات مثل محدِّد الهوية الفريد، الذي قد لا يكون موجوداً في المعادِلات الورقية.

After discussion, the Working Group agreed to retain only the first part of paragraph 1 and to further consider how such requirements would be met with respect to the use of electronic transferable records once it had discussed the relevant draft articles on uniqueness, integrity and control.
50- وبعد النقاش الذي أجراه الفريق العامل اتفق على الإبقاء على الجزء الأول فقط من الفقرة 1، وعلى مواصلة النظر في كيفية استيفاء تلك الاشتراطات فيما يخصُّ استخدام السجلات الإلكترونية القابلة للتحويل عند انتهائه من مناقشة مشاريع المواد ذات الصلة التي تتحدَّث عن التفرُّد والسلامة والسيطرة.

In that context, it was mentioned that the need for consent to the use of electronic transferable records, explicit or implicit (as provided in article 8, paragraph 2, of the Electronic Communication Convention), would also need to be addressed.

26. Working Group IV (Electronic Commerce) had continued preparing draft provisions to enable the use of electronic transferable records.
٢٦ - وواصل الفريق العامل الرابع (التجارة الإلكترونية) إعداد مشاريع الأحكام التي ستمكن من استخدام السجلات الإلكترونية القابلة للتحويل.

After discussion, it was agreed that paragraph 1 should be recast as a functional equivalence rule possibly providing guidance on the elements to be considered to enable the use of electronic transferable records as collateral in secured transactions.

30- وختاما، ذُكر أنَّ استخدام السجلات الإلكترونية القابلة للتحويل عبر الحدود يستدعي مناقشة مختلف الجوانب القانونية المعقدة للمعاملات الإلكترونية، وأنَّ الأونسيترال هي في موقع فريد يؤهلها للقيام بعمل من هذا القبيل، نظرا لتركيبتها وما تمتلكه من خبرات فنية.

The question was raised with respect to the compatibility between the use of electronic transferable records, on the one hand, and the provisions contained in the Convention Providing a Uniform Law for Bills of Exchange and Promissory Notes (Geneva, 7 June 1930) and the Convention Providing a Uniform Law for Cheques (Geneva, 19 March 1931).

It was explained that the functional equivalent of the paper-based notion of original was of limited practical use with respect to the use of electronic transferable records since all related legal needs could be satisfied by establishing the functional equivalents of the paper-based notions of authenticity, uniqueness, and integrity, which were addressed, respectively, in draft articles 9, 13 and 14.
