64. It was the Working Group's understanding that ERAs could be used in other procurement methods as well as tendering proceedings.

The Guidelines also, with the reference to the discussions in the UNCITRAL Working Group, adopted the approach of treating ERAs as a procurement method in itself, rather than an optional phase in other procurement methods.

(b) By means of other procurement methods, in accordance with the relevant provisions of chapters II, IV and V of this Law, except to the extent that those provisions are derogated from in this chapter.

14. Some information required to be provided for other procurement methods is not appropriate in the context of ERAs, and so does not appear in paragraph (1).

It was observed that there were two systems of ERAs in current use: those that treated ERAs as a procurement method itself, and those that treated ERAs as an optional phase in other procurement methods.

(d) Anonymity: the maintenance of anonymity is critical if there are not to be higher risks of collusion in ERAs than in other procurement methods.

1. The article sets out the procedures for soliciting participation in procurement by means of a stand-alone ERA, i.e. where an ERA is used as a procurement method rather than a final phase before the award of a procurement contract in other procurement methods or under framework agreements.
1- تبيّن هذه المادة إجراءات التماس المشاركة في الاشتراء بواسطة مناقصة إلكترونية قائمة في حد ذاتها، أي في الحالات التي تُستخدم فيها المناقصة كأسلوب اشتراء لا كمرحلة نهائية تسبق إرساء عقد الاشتراء في إطار أساليب اشتراء أخرى أو بموجب اتفاقات إطارية.

(ii) Suppliers and contractors, especially SMEs, will need to be aware and understand the changes involved in doing business with the government through an ERA and what impact these changes will have on their businesses. Otherwise, a marketplace where procurement was previously handled successfully through other procurement techniques may be abandoned, and the government investment in the ERA system may fail;
`2` يتعيّن على المورِّدين والمقاولين، وبخاصة المنشآت الصغيرة والمتوسطة، أن يدركوا ويفهموا ما ينطوي عليه التعامل التجاري مع الحكومة بواسطة المناقصة الإلكترونية من تغييرات وما سيترتّب على هذه التغييرات من آثار في أعمالهم التجارية؛ وإلاّ فإنَّ السوق التي كان يُزاول فيها الاشتراء بنجاح في السابق بواسطة أساليب اشتراء أخرى قد تُهجر، والاستثمار الحكومي في نظام المناقصات الإلكترونية قد يُخفق؛

50. The Working Group also agreed that the Model Law should not prevent appropriate use of ERAs as a procurement tool in procurement methods other than tendering, such as request for quotations, as well as in any other procurement techniques that may be envisaged by the revised Model Law, such as framework agreements and dynamic purchasing systems.
50- واتفق الفريق العامل أيضا على أن القانون النموذجي لا ينبغي أن يمنع استخدام المناقصات (المزادات العكسية) الإلكترونية كأداة للاشتراء في أساليب اشتراء غير المناقصة، مثل طلب عروض الأسعار، وكذلك في أي أساليب اشتراء أخرى قد يرتئيها القانون النموذجي المنقح، مثل الاتفاقات الإطارية ونظم الشراء الدينامي.

(e) If the procuring entity uses a method of procurement other than open tendering, a statement of the reasons and circumstances relied upon by the procuring entity to justify the use of such other method;
(ﻫ) في حال استخدام الجهة المشترية طريقة اشتراء أخرى غير المناقصة المفتوحة، بياناً بالأسباب والظروف التي استندت إليها الجهة المشترية لتسويغ استخدام تلك الطريقة الأخرى؛

2. A procuring entity may use a method of procurement other than open tendering only in accordance with articles 29 to 31 of this Law, shall select the other method of procurement to accommodate the circumstances of the procurement concerned and shall seek to maximize competition to the extent practicable.
2- لا يجوز للجهة المشترية أن تستخدم طريقة اشتراء أخرى غير المناقصة المفتوحة إلا وفقا للمواد 29 إلى 31 من هذا القانون، وتختار طريقة الاشتراء الأخرى تلك بما يناسب ظروف الاشتراء المعني، وتسعى إلى زيادة التنافس إلى أقصى مدى ممكن عملياً.

3. If the procuring entity uses a method of procurement other than open tendering, it shall include in the record required under article 25 of this Law a statement of the reasons and circumstances upon which it relied to justify the use of that method.
3- إذا استخدمت الجهة المشترية طريقة اشتراء أخرى غير المناقصة المفتوحة، فعليها أن تُدرج في السجل المطلوب بمقتضى المادة 25 من هذا القانون بياناً بالأسباب والظروف التي استندت إليها في تسويغ استخدام تلك الطريقة.
