Where a contracting state makes extradition conditional on the existence of a treaty receives a request for extradition from another contracting state with which no extradition treaty exists the requested state may consider this Convention as the basis for extradition in respect to the listed offences.
وعندما تتلقى دولة متعاقدة، تجعل التسليم مشروطا بوجود معاهدة، طلبا للتسليم من دولة متعاقدة أخرى لا توجد معها معاهدة تسليم فإنه يجوز للدولة المطلوب منها التسليم اعتبار هذه الاتفاقية أساس التسليم فيما يتعلق بالجرائم المذكورة فيها.

" 2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may at its option consider this Convention as the legal basis for extradition in respect of those crimes.
" ٢ - إذا تلقت دولة طرف تعلﱢق تسليم المجرمين على شرط وجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة تسليم، فلها أن تختار اعتبار هذه الاتفاقية اﻷساس القانوني للتسليم بخصوص تلك الجرائم.

If a State party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State party with which it has no extradition treaty, it may consider this Convention as the legal basis for extradition in respect of such offences.
إذا تسلمت دولة طرف طلباً للتسليم من دولة لا تربطها بها معاهدة لتسليم المجرمين، وكانت الدولة الأولى تجعل التسليم مشروطاً بوجود معاهدة لتسليم المجرمين، يجوز لهذه الدولة اعتبار هذه الاتفاقية أساساً قانونياً للتسليم فيما يختص بمثل هذه الجرائم.

6. States Parties which, pursuant to paragraph 2 of this article, have agreed to consider this Convention as a legal basis for extradition in respect of the offences set forth in article 2 may consider utilizing the procedures set out in Annex III.
6 - يمكن للدول الأطراف، التي وافقت، عملا بالفقرة 2 من هذه المادة، على اعتبار هذه الاتفاقية أساسا قانونيا لتسليم المجرمين في الجرائم المنصوص عليها في المادة 2، أن تنظر في استخدام الإجراءات الواردة في المرفق الثالث.

2. If a Contracting State that makes extradition conditional on the existence of a treaty receives a request for extradition from another Contracting State with which it has no extradition treaty, the requested State may at its option consider this Convention as the legal basis for extradition in respect of the offences referred to in article 2.
٢ - إذا تلقت دولة متعاقدة، تعلق تسليم المجرمين على شرط وجود معاهدة، طلب تسليم من دولة متعاقدة أخرى لا ترتبط معها بمعاهدة لتسليم المجرمين، لها أن تختار اعتبار هذه الاتفاقية اﻷساس القانوني للتسليم فيما يتعلق بالجرائم المشار إليها في المادة ٢.

2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, the requested State Party may at its option consider this Convention as a legal basis for extradition in respect of the offences set forth in article 1.
٢ - إذا تلقت دولة طرف، تجعل التسليم مشروطا بوجود معاهدة، طلب تسليم من دولة طرف أخرى لا تربطها بها معاهدة لتسليم المجرمين، جاز للدولة الطرف المتلقية للطلب أن تختار اعتبار هذه الاتفاقية سندا قانونيا للتسليم فيما يتعلق بالجرائم المذكورة في المادة ١.

2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may at its option consider this Convention as the legal basis for extradition in respect of those crimes.
٢ - إذا تلقت دولة طرف تعلﱢق تسليم المجرميـن على شرط وجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة تسليم، فلها أن تختار اعتبار هذه الاتفاقية السند القانوني للتسليم فيما يتعلق بتلك الجرائم.

2 - إذا تلقت دولة من الدول الأطراف تعلق تسليم المجرمين على شرط وجود معاهدة طلبا بتسليم المجرمين، من دولة أخرى من الدول الأطراف لا ترتبط معها بمعاهدة لتسليم المجرمين، فلها، إذا قررت التسليم، اعتبار هذه الاتفاقية الأساس القانوني للتسليم بخصوص الجرائم المبينة.

2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may consider this Convention as the legal basis for extradition in respect of such offences.
2- إذا تسلمت دولة طرف طلباً للتسليم من دولة لا تربطها بها معاهدة لتسليم المجرمين، وكانت الدولة الأولى تجعل التسليم مشروطاً بوجود معاهدة لتسليم المجرمين، يجوز لهذه الدولة اعتبار هذه الاتفاقية أساساً قانونياً للتسليم فيما يختص بمثل هذه الجرائم.

2. If a State party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State party with which it has no extradition treaty, the requested State party has the option to consider this Convention as a legal basis for extradition with respect to the offence of piracy.
2 - إذا تسلمت دولة طرف طلبا للتسليم من دولة لا تربطها بها معاهدة لتسليم المجرمين، وكانت الدولة الأولى تجعل التسليم مشروطا بوجود معاهدة لتسليم المجرمين، يجوز لهذه الدولة اعتبار هذه الاتفاقية أساسا قانونيا للتسليم فيما يتعلق بجريمة القرصنة.

Such concerns were repeated in plenary in the final debate on the draft convention and, following a heated discussion, the proposal was amended to provide that the State concerned " may at its option consider this Convention as the legal basis for extradition in respect of the offence " (emphasis added).
