Paragraph 4 deals with the determination of the fees in the award and provides a review in case the fees and expenses would be manifestly excessive.

The Commission agreed to replace the words " in its review " with the words " if adjustment of fees and expenses is necessary " in the second sentence of paragraph 60 of document A/CN.9/746/Add.1.

Without such oversight, the parties would have no direct recourse under the revised Rules against requests for deposits and interim payments that they consider to be " manifestly excessive " or inconsistent with the method for determination of fees and expenses set under Article 41 (3).

It was further proposed to delete the words " pursuant to article 38 " at the end of paragraph 4 and to add a sentence at the end of paragraph 4 along the lines of " Article 38, paragraph 3, shall apply. " , which would clarify that the adjustments to be made on the fees and expenses were not errors or omissions in the sense of draft article 38, but that the procedure of draft article 38, paragraph 3, applied.
171- واقتُرِح كذلك حذف عبارة " بمقتضى المادة 38 " الواردة في نهاية الفقرة 4، وإضافة جملة في نهاية الفقرة 4 من قبيل " وتنطبق أحكام الفقرة 3 من المادة 38. " ، الأمر الذي من شأنه أن يوضح أن التعديلات المقرر إدخالها على الأتعاب والنفقات ليست حالات خطأ أو سهو بالمعنى المقصود في مشروع المادة 38، وإنما الإشارة إلى تطبيق الإجراءات المنصوص عليها في الفقرة 3 من مشروع المادة 38.

Within 15 days of receiving the arbitral tribunal's determination of fees [and expenses], any party may refer for review such determination to the appointing authority or, if no appointing authority has been agreed upon or designated or if such an appointing authority fails, refuses, or is unable to fulfil its functions under this paragraph, to the Secretary-General of the PCA.

I further note that Articles 40 to 43 on costs foresee the possibility that the appointing authority or the PCA (pursuant to Article 6 (4) or 41 (4)) could intervene in cases of " manifestly excessive " fees and expenses of the arbitral tribunal, only (1) after the issuance of the award or other decision fixing said fees and expenses, and (2) upon a specific party request for review of a particular decision.
وأشيرُ كذلك إلى أن المواد من 40 إلى 43 المتعلقة بالتكاليف لا تتوخى إمكانية تدخّل سلطة التعيين أو الأمين العام لمحكمة التحكيم الدائمة (عملا بالمادة 6 (4) أو 41 (4)) في الحالات التي تكون فيها أتعاب هيئة التحكيم ونفقاتها " مفرطة على نحو بيّن " إلا: (1) بعد إصدار قرار تحكيم أو قرار آخر يحدد الأتعاب والنفقات المذكورة، و(2) عند تقدّم طرف بطلب محدد لإعادة النظر في قرار معيّن.

In addition, the third sentence of the paragraph should be amended to begin as follows: " If, and to the extent that, the appointing authority finds that the arbitral tribunal's determination of fees and expenses is inconsistent with the fee proposal, or is otherwise manifestly excessive, the appointing authority or the Secretary-General of the PCA shall, within 45 days of receiving such a referral, make any necessary adjustments ... " .

Mr. Castello (United States of America) said that, in his observations regarding draft article 40, paragraph 2 (f) (A/CN.9/704), the Observer of the Permanent Court of Arbitration (PCA) had noted that, although the definition of costs included both " the fees and expenses " of the appointing authority, that same definition only included the " expenses " of the Secretary-General of PCA.
