Article 12 set forth the obligations which States parties accepted in order to enable the Sub—Committee to conduct its missions in general, whereas article 13 indicated the exceptional circumstances under which a State could object to a visit, and not to a mission.

7.4 As to the author's claims regarding his detention without charge for 7 days, the State party notes that the Code of Criminal Procedure allows a suspect to be detained without being charged for a period of up to 10 days in exceptional circumstances.

60. The representative of China felt that the list of exceptional circumstances should be comprehensive and even exhaustive and proposed adding to it such considerations as the health status of the person to be visited, urgent interrogation for a serious crime, and serious natural disaster.

It is the view of the Committee that segregated schooling may only in exceptional circumstances be considered as being in conformity with article 2 in conjunction with article 5 (e) (v) of the Convention.

115- غير أنه ذُكر أنه قد توجد حالات أخرى لا تشابه الأمثلة الواردة في إطار الفقرة الفرعية (ب)، حيث ينبغي فيها لهيئة التحكيم أن تتَّخذ تدابير لتقييد النشر، وأنَّ الإشارة إلى " الأحوال الاستثنائية المشابهة " قد تكون مفرطة التقييد.

Article 34: " Every citizen is free to choose his own occupation, profession or trade, subject to the limits laid down by law and having due regard for the legislation regulating certain professions and trades. No person may be subjected to forced labour other than in the exceptional circumstances provided for by law and in return for compensation.
