In the First Report the Panel considered claims for termination payments made by two Governments to their local employees upon the closure of their Embassies in Iraq and Kuwait and determined that payments made pursuant to contractual obligations should be compensated to the extent that they are adequately supported by documentary or other appropriate evidence.The First Report, para. 68.

In the First and Third Reports, the Panel established a number of principles governing the compensability of claims for evacuation costs. / The Panel determined, inter alia, that costs incurred by Governments in evacuating individuals from Iraq, Kuwait, Israel and Saudi Arabia during the period 2 August 1990 to 2 March 1991 are compensable, to the extent they are supported by sufficient documentary and other appropriate evidence.
70- وضع الفريق في التقريرين الأول والثالث عدداً من المبادئ التي تنظم قابلية المطالبات المتعلقة بتكاليف الإجلاء للتعويض(36). ورأى الفريق، ضمن جملة أمور، أن التكاليف التي تكبدتها الحكومات عند إجلاء أفراد من العراق والكويت وإسرائيل والمملكة العربية السعودية أثناء الفترة من 2 آب/أغسطس 1990 إلى 2 آذار/مارس 1991، تكاليف قابلة للتعويض إذا كانت مدعمة بما يكفي من الأدلة المستندية وغيرها من الأدلة الملائمة.

The Panel has previously determined that, for the reasons given by it with respect to the compensability of claims for damage to real property, claims for loss of tangible property located in Iraq or Kuwait are also compensable to the extent that they are supported by sufficient documentary and other appropriate evidence. / The Panel considers that those reasons are also applicable here.
