يجوز حجب البيانات والمعلومات الحيوية للأمن القومي لدولة المصدر أو لحماية الأسرار الصناعية أو المتعلقة بالملكية الفكرية، ولكن يجب على دولة المصدر أن تتعاون بحسن نية مع الدولة التي يحتمل أن تتأثر في تقديم ما يمكن تقديمه من المعلومات في هذه الظروف.

With regard to draft article 18, which protected an aquifer State from being compelled to provide data or information the confidentiality of which was essential to its national defence or security, his delegation would like to reiterate its position that protection under the draft article should be extended to industrial secrets and intellectual property.

His delegation was opposed to the inclusion of any reference in the draft articles to the protection of industrial secrets: in the case of shared aquifers such a provision was illogical, since it could be used as a pretext for concealing information about industrial activities that polluted groundwaters or for withdrawing excessive amounts of water.

(3) It is also noted that a suggestion was made to add the protection of industrial secrets and intellectual property to the text of the draft article, in line with article 14 of the draft articles on Prevention of Transboundary Harm from Hazardous Activities.
