Where this is not realized, mere passivity on the part of the State would, however, constitute a violation of the right of persons with disabilities to participate in political and public life on an equal basis with others.

Recalling that the above-mentioned article 29 of the Convention reaffirms the right of persons with disabilities to participate in political and public life, and that parties to the Convention are required to guarantee political rights to persons with disabilities and adopt all appropriate measures to ensure that they enjoy these rights on an equal basis with others,

Failure to guarantee accessibility by means of reasonable accommodation and universal design, as defined in article 2 of the Convention, would infringe the right to political participation of persons with disabilities and the principle of equality and non-discrimination (art. 5).
